1. This petition has been filed by petitioner – Ankit Kumar, who has taken admission in LL.M. course in Geeta Institute of Law, Panipat, Haryana, which is a college affiliated to Kurukshetra University, Kurukshetra.

2. The college having offered admission, also accepted fee from the petitioner but the course itself was not allowed to be pursued as the University was of the view that the college had no authority to admit the petitioner.

3. Reply has been submitted by the Kurukshetra University, in which following stand is taken in para No.4:-

4. That it is respectfully submitted that the admission of the petitioner in LLM 1st Year for the session 2021-22 was done by the respondent no.2 & 3 i.e. College. After admission, documents of the petitioner were sent to the answering respondent university for eligibility registration. The admission and its petitioner During of the provisional. was verification of the documents, it was found by the Chairman Department of Law that the admission of the petitioner has been wrongly done by the respondent no.2 and 3 under reserved S.C. Category as the benefit of reserved S.C. Category is available to the S.C. Candidates of Haryana State only and the petitioner belongs to State of Uttar Pradesh and the certificate of reserved S.C. Category has been issued by the Govt. of Uttar Pradesh. Therefore, petitioner was admission the cancelled ab-initio of the by the answering respondent university strictly as per applicable rules and a well reasoned and legal Sacrosanct order dated 03.08.2022 (Annexure P-1) has been issued by the answering respondent University. The relevant part of the order dated 03.08.2022 is reproduced as under:

"Subject: Cancellation of Admission of Mr.Ankit Kumar Student of L.L.M. 1st year for the session 2021-22.

Sir, Madam I am directed to inform you that the admission case of Mr. Ankit Kumar student of LLM 1st year was examined by the Chairman Department of Law, KUK and he has informed that Under SC category only SC's of Haryana are eligible. In the present case SC certificate is of Uttar Pradesh. Hence the candidate is not eligible under SC category of Haryana.

However the candidate may be considered eligible category, if having 55% marks or more in LLB. But the candidate has secured only 53.13% marks. Therefore, the admission of Mr. Ankit Kumar, LLM 1st year student for the session 2021-22 has been cancelled ab-initio .Further, you are advised to be more care full in future."

Thus, after considering all these facts, the admission of the petitioner in LLM 1st year for the sessions 2021-22 was cancelled ab-initio strictly as per applicable rules of the University and the respondent no.2 and 3 were advised to be remain more careful in future. Hence, the present writ petition is not maintainable against the answering respondent university and regarding refund of fee pertains to the issue respondent no.2 and 3 only. The letter dated 03.08.2022 (Annexure P-1) regarding cancellation of admission of the petitioner in LLM 1st year for the sessions 2021-22 is strictly as per rules and regulations of the university and hence is legal and sacrosanct, therefore, the present writ petition is liable to be dismissed qua the answering respondent university.”

4. In view of the stand taken by the University, the admission offered to the petitioner has been cancelled. Grievance of the petitioner is that fee deposited by him, has not been refunded by the college. It is submitted that once the admission of the petitioner is cancelled, the college has no right to retain the fee.
