1. Instant petition under Section 482 BNSS, 2023 read with Section 528 of BNSS, 2023 has been filed for grant of interim bail for 15 days to the petitioner to perform the last rites on account of death of his only real brother and further for setting aside the impugned order dated 27.11.2025 (Annexure P-3) passed by learned Judge, Special Court, Bathinda vide which the application seeking interim bail of the petitioner had been dismissed.

2. Learned counsel for the petitioner has submitted that the petitioner deserves concession of interim bail as his only real brother namely Naresh had died in a road accident on 24.11.2025. He further submits that the presence of the petitioner is essential to perform the last rites of his deceased brother who is survived by two minor children.
