1. Prayer in the present petition filed under Section 483 BNSS is for grant of regular bail to the petitioner in case FIR No.49 dated 18.03.2020, registered under Sections 302, 380, 34 IPC and Sections 411, 460 IPC (added later on), at Police Station Gidderbaha, District Sri Muktsar Sahib.
2. Learned counsel contends that the petitioner has been in custody for 5 years, 8 months and 2 days. He was not named in the FIR, rather it is during the investigation that he came to be implicated in the present case on 18.03.2020. As per the allegations, he is seen in the CCTV of a neighbor, Gurcharan, however, no overt act has been attributed to him. Even in the supplementary statement of brother of the deceased, his name had not been mentioned. Charges have been framed on 02.04.2021, however, 16 witnesses still remain to be examined while the complainant and brother of the deceased stand examined. He is not involved in any other case.
3. The custody certificate dated 1344.02.2025, filed by the learned State counsel is taken on record. As per the same, the petitioner is behind bars for 5 years, 8 months and 2 days.
