1. Present revision petition has been filed under Article 227 of the Constitution of India for issuance of directions to the Principal Judge, Family Court, Sri Muktsar Sahib at Camp Court, Malout, to expeditiously decide the divorce petition and application for examination of petitioners through Video Conferencing in said divorce petition.

2. Brief facts of the case are that the marriage between the parties was solemnized on 27.03.2010 at Gurdwara Dukh Niwaran Sahib, Gidderbaha, District Sri Muktsar Sahib, Punjab. The parties got their marriage registered on 17.05.2010 at the office of Marriage Officer-cum-Deputy Commissioner, Muktsar. Out of the said wedlock a male child, namely, Amer Singh Dhaliwal, was born on 2.07.2013 at Paola Memorial Hospital, Samsennai Sub-Distt. Phaya Thai, Bangkok Metropolis, Thailand. After some time the relationship between the parties became strained and both the parties agreed to part their ways by taking divorce with mutual consent. They executed a compromise deed dated 09.10.2024. Thereafter, they filed a petition for dissolution of marriage under Section 28 of the Special Marriage Act, 1954 along with applications under Section 13 of the Family Courts Act, 1984 on 29.07.2025. Since then, the divorce petition and the application for examination through Video Conferencing are pending. Hence, the present revision is filed.

3. Learned counsel for the petitioner submits that the parties are currently residing in Thailand and are, therefore, unable to appear in person before the Court in India. He further submits that the parties to the lis are governed by the provisions of the Special Marriage Act, 1954. He further submits that the Rules and Orders of the Hon’ble Punjab and Haryana High Court permit the examination of persons through video conferencing where it is expedient to do so. Hence, the request made in the application for recording the petitioners’ statements through video conferencing ought not to have been unnecessarily adjourned by the Family Court. Counsel also submits that the parties have been living separately for more than two years. He therefore prays that a direction be issued to the Principal Judge, Family Court, Sri Muktsar Sahib, at Camp Court, Malout, to expeditiously decide both the divorce petition and the pending application seeking examination of the petitioners through video conferencing.

4. Since the short controversy is involved in the present revision petition, no notice is required to be issued to the respondents.

5. The application for examination of parties through video conferencing was filed on 29.07.2025 and is still pending for disposal.

6. Keeping in view the above facts and submissions, this Court deems it appropriate to direct the Principal Judge, Family Court, Sri Muktsar Sahib, Camp Court Malout, to consider and decide the application for examination of the petitioners through video conferencing expeditiously, in accordance with law.

7. Consequently, the present revision petition is allowed and the Principal Judge, Family Court, Sri Muktsar Sahib, Camp Court Malout, is requested to decide the pending application for examination of the petitioners through video conferencing expeditiously, in accordance with law, preferably within one month after the receipt of certified copy of this order.

8. Pending applications, if any, also stand disposed off.
