CRM-46891-2025 The present application has been filed for placing on record the petition under Section 125 Cr.P.C. before the Family Court at Patiala as Annexure P-8.
Application is allowed as prayed for.
Annexure P-8 is taken on record, subject to all just exceptions.

1. The present petition has been filed seeking transfer of case bearing No. MNT125 41/2021, dated 29.01.2021, titled “Gurveen Kaur and another vs. Manmeet Singh”, filed under Section 125 of the Code of Criminal Procedure (hereinafter referred to as “Cr.P.C.”), from the Court of the learned Principal Judge, Family Court, Patiala, to a Court of competent jurisdiction except District Patiala.
2. Learned counsel for the petitioner submits that during the pendency of the present petition, the respondent has also shifted to SAS Nagar (Mohali) and is presently working there. It is further submitted that the divorce petition filed by the petitioner is also pending at SAS Nagar (Mohali). Therefore, it would be in the interest of both the parties that the matter be transferred to SAS Nagar (Mohali).

Vide order dated 06.07.2022, Mr. Paras Jagga, Advocate, had put in appearance on behalf of respondent and filed his Power of Attorney, however, subsequently he absented himself, and thereafter, vide order dated 02.09.2025, it was directed that a copy of the order be sent to Mr. Paras Jagga, Advocate (for respondent), as well as to the respondent through her counsel appearing before the Family Court, Patiala.
4. As per the office report, the copy of the order dated 02.09.2025 has been sent to Mr. Paras Jagga, Advocate, for respondent. However, the counsel representing respondent at Family Court, Patiala could not be served.
5. Therefore, keeping in view the above, the rights of the respondent is kept open, in case, she is aggrieved by the said order, the present petition is allowed, without commenting on the merits of the case. Consequently, case bearing No. MNT125 41/2021, titled as “Gurveen Kaur and another vs. Manmeet Singh”, pending before the Court of the learned Principal Judge, Family Court, Patiala, is hereby transferred to the Court of competent jurisdiction at SAS Nagar (Mohali).
6. The learned District Judge, Patiala is directed to transfer complete record pertaining to the aforesaid case to District Judge, SAS Nagar (Mohali).
7. The parties, through their counsel are directed to appear before the District & Sessions Judge, SAS Nagar (Mohali) within a period of one month.
8. The District Judge, SAS Nagar (Mohali) will assign the said petition to the Court of Competent Jurisdiction.
9. The entire consequential proceedings emanating from the said case are also directed to be transferred from the concerned Court at Patiala to the Court of Competent Jurisdiction at SAS Nagar (Mohali).
10. With the aforesaid liberty to the respondent, the present petition stands disposed of in the above-said terms.
11. Pending application(s), if any, shall stand disposed of.
