1. Present petition has been filed under Section 483 of the
Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of
regular bail to the petitioner in case FIR No.39 dated 9.10.2025 under
Section 7 of Prevention of Corruption Act, 1988 (Sections 13(1)(b) and
13(2) of P.C. Act added later on), registered at Police Station ACB, Hisar,
District Hisar.
2. The case set up in the FIR in question (as set out in the present
petition by the petitioner) is as followed:
‘First Information Contents: To, The Hon'ble Inspector Sir, State
Vigilance & Anti-Corruption Bureau, (Haryana) Sub-Centre, Sirsa. Sir, it
is respectfully submitted that I, Bhupinder Singh @ Mogi, son of Shri Om
Prakash, am the resident of Village Dudhiyan Wali, District Sirsa. My
brother Radha Krishan @ Radhe, son of Shri Om Prakash, resident of
Village Dudhiya Wali, District Sirsa, is in Custody in FIR No. 364 dated
19.07.2025, under Sections 305, 317(2), 318(4), 336(3), 338, 340 of BNS
2023 and Section 25(1)(a) of the Arms Act, Police Station Rania, District

Sirsa, in District Jail, Sirsa for approximately 80 days. The investigation
of this case is being conducted by Anil Kumar, ASI, Police Station Rania.
About one and a half months ago, my father Om Prakash met Anil Kumar,
ASI at Police Station Rania, regarding filing of challan (charge-sheet) in
the Court in the case of my brother Radha Krishan @ Radhe. At that time,
Anil Kumar, ASI, told my father that a challan is not submitted in Court
just like that, and after putting pressure on my father, Anil Kumar, ASI,
forcibly took a bribe of Rs. 10,000/- in the name of filing the challan in
Court, inside Police Station Rania. Even after that, Anil Kumar, ASI still
has not filed the challan in the Court. I and my father are repeatedly
requesting Anil Kumar, ASI to file the challan in the Court. Yesterday, on
08.10.2025, in the afternoon, I met Anil Kumar, ASI, at Police Station
Rania regarding the submission of the challan of my brother Radha
Krishan @ Radhe in the Court. At that time, Anil Kumar, ASI, demanded a
bribe of Rs. 26,000/-, stating that Rs. 7,000/- and Rs. 4,000/- were his file-
related expenses, and Rs. 15,000/- were required for obtaining vehicle
details, for submitting the challan in Court. I have recorded the
conversation between me and Anil Kumar, ASI, regarding the demand and
taking of this bribe, in my device, and I will produce the said recording
before you. I do not want to pay this bribe amount of Rs. 26,000/- to Anil
Kumar, ASI. Therefore, it is requested that legal action be taken against
Anil Kumar, ASI, Police Station Rania. Sd/-Bhupinder Singh son of Om

3. Learned counsel for the petitioner has argued that the petitioner
is in custody since 9.10.2025. Learned counsel has further submitted that
the petitioner has been falsely implicated into the FIR in question as he
was Investigating Officer of a FIR against the brother of the complainant.
Learned counsel has further submitted that the sodium phenolphthalein
solution did not turn pink. Learned counsel has further submitted that
recovery of the bribe money is not from the petitioner but from a
polythene bag in his office. Thus, liability thereof cannot be fastened
