IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
MUSTAK – Appellant
Versus
STATE OF HARYANA – Respondent
IN THE HIGH COURT FOR THE STATES OF PUNJAB AND HARYANA AT CHANDIGARH
240 CRM-M-50330-2025 (O&M) Date of decision : 19.12.2025 Mustak ...Petitioner Versus State of Haryana ...Respondent CORAM: HON'BLE MRS. JUSTICE MANISHA BATRA Present:- Mr. Munfaid Khan, Advocate for the petitioner.
Mr. Neeraj Poswal, AAG, Haryana.
MANISHA BATRA, J. (Oral)
1. Prayer in this petition, filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, is for grant of regular bail to the petitioner in FIR No. 156 dated 04.07.2025, registered under Sections 3/13(1), 8/13(3) and 17 of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act at Police Station Sadar Tauru, District Nuh.
2. Brief facts of the case relevant for the disposal of the present petition are that on 04.07.2025, a secret information was received to the effect the business of cow slaughtering and on that day, they were present in the house of co-accused Sagru for the purpose of slaughtering. Believing the information to be true, a raiding party was immediately formed, which reached at the informed place, where four persons were found, out of them, two persons succeeded in running away, whereas the petitioner and co-accused Jamshed were apprehended. On search, 80 kgs. of beef along with slaughtering weapons was recovered, which was taken into possession by the police. Investigation now stands completed and challan has been filed. The petitioner along with the co-accused is facing trial for commission of aforementioned offences.
3. It is argued by learned counsel for the petitioner that he has been falsely implicated in this case. No independent witness was joined at the time of alleged raid, recovery or arrest. The entire prosecution case is based on the statements of the police officials. The recovery, if any, was effected from the house of co-accused Sagru and not from the petitioner. Even otherwise, investigation has since been completed and challan has been filed. Conclusion of trial is likely to take time. The petitioner has clean antecedents. Co-accused Sagru was subsequently arrested and now has been granted concession of regular bail by the learned trial Court, vide order dated 21.11.2025. On parity, the petitioner too deserves to be given the same benefit. No useful purpose would be served by keeping him in custody anymore. Therefore, it is urged that the petition deserves to be allowed and the petitioner deserves to be released on regular bail.
4. Status report along with the custody certificate of the petitioner has been filed by the respondent-State. Learned State counsel has argued that keeping in view the gravity of the allegations levelled against the petitioner, he is not entitled to get benefit of bail. It is, thus, argued that the petition is liable to be dismissed.
5. This Court has heard the rival submissions.
illegal business of cows slaughtering. He was arrested on 04.07.2025. He has clean antecedents. Though the allegations make out a prima facie case against the petitioner, however, as per the status report, investigation has since been completed and challan has been presented. Conclusion of trial would obviously take time. Co-accused Sagru has already been granted concession of regular bail by the learned trial Court, as mentioned above. Keeping in view the aforesaid facts and circumstances, this Court is of the considered opinion that no useful purpose would be served by keeping the petitioner in custody anymore. Accordingly, the present petition is allowed. The petitioner is ordered to be released on regular bail, subject to his furnishing personal/surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned. However, it will be open for the prosecution to apply for cancellation of bail in case the petitioner is found involved in any other subsequent case.
7. It is made clear that any observation made herein above is only for the purpose of deciding the present petition and the same shall have no bearing on the merits of the case.
