1. The present writ petition has been filed under Article 226/227
of the Constitution of India for issuance of an appropriate writ or order in
the nature of certiorari for quashing the impugned order dated 04.08.2017
(Annexure P-10), order dated 02.02.2016 (Annexure P-4) and order dated
21.03.2018 (Annexure P-11) vide which the promotion of petitioner from
the post of Senior Assistant to Superintendent Grade-2 has been rejected and
also to quash the impugned order dated 03.07.2015 (Annexure P-3) vide
which the persons junior to petitioner as per seniority list up to 30.09.2011
(Annexure P-2) have been promoted. Further praying for issuance of a writ
in the nature of mandamus directing the respondents to decide the case of

petitioner on the basis of recommendations and letter (Annexure P-12 to P-
14). Further praying for directing the respondents to decide the
representations dated 17.06.2020, 17.08.2022 and 21.02.2023 (Annexure P-
15 to P-17) respectively and further directing the respondents to revise the
last pay certificate of petitioner and to revise the pensionary benefits and
also to revise the monthly pension of petitioner and to make the payment of
arrears of salary along with interest @ 12% per annum.
2. Learned counsel for the petitioner at this stage submits that he
would be satisfied if the representations dated 17.06.2020, 17.08.2022 and
21.02.2023 (Annexure P-15 to P-17) respectively of the petitioner is decided
by respondents No.1 and 3/competent authority by passing a speaking order
in a time bound manner.
3. The learned State Counsel submits that he has no objection, in
case a direction is issued to respondents No.1 and 3 for time-bound
consideration and to take a decision of the representations (Annexure P-15
to P-17) filed by the petitioner by passing a speaking order.
4. Therefore, in view of the limited prayer made by learned
counsel for the petitioner, respondents No.1 and 3/competent authority is
directed to consider the representations dated 17.06.2020, 17.08.2022 and
21.02.2023 (Annexure P-15 to P-17) respectively of the petitioner and pass a
well reasoned speaking order after affording an opportunity of hearing to the
petitioner, within a period of 03 months from the date of receiving a

certified copy of this order. Further, the decision taken thereof shall be
conveyed to the petitioner.
5. Needless to say, if the petitioner is found entitled to the relief

application(s), if any.
