1. Through the instant petition cast under Article 226 of the Constitution of India, a prayer is made for issuance of a direction upon the respondent authorities, especially, respondent no.5, to allow the petitioners to appear in examinations in consideration with the approval already given by Vice-Chancellor, for one-time special exemption for promotion in next semester, in parity with the other students whose names have been considered in view of the letter dated 02.09.2024 of the office of the Dean Student Welfare, and to allow them to appear in the examinations for the third semester (2^nd year).

2. Learned counsel for the petitioners submits that the respondent-university has deliberately withheld their result of first semester examinations. However, the petitioners were promoted to second semester, and in second semester, petitioner no.1 could not appear in two exams whereas, petitioner no.2, could not appear in three exams, due to medical reasons. Now, despite the students having been granted one-time special exemption to appear in third semester examinations, the Chairman, of the Law Department, is not allowing the petitioners to appear in the ongoing third semester examinations.

3. He also placed reliance upon a copy of letter dated 29.11.2024 (Annexure P-8), to submit that, specifically, one-time special exemption was granted to the petitioners.

4. This Court has put a specific query to learned counsel for the petitioners, as to when, the third semester examinations are scheduled to commence, to which he fairly concedes that the same have already commenced, and furthermore, exams of three subjects are already over.

5. This Court vide order dated 19.12.2025, had issued notice of motion, and in pursuance to which, today, Ms.Shreya Kaushik, Advocate, has caused appearance for all the respondents.

6. She strongly opposes the prayer as made by learned counsel for the petitioners, and submits that there is material concealment of facts. The result of first semester examinations of the present petitioners, has been withheld for the reason that they did not to appear in the internal examinations, hence, they got zero marks.

7. She further submits that in order to mitigate the hardship to the petitioners they were given two/three effective opportunities;

however, they did not appear in the internal examinations. Therefore, unless and until the petitioners clear internal examinations, their result for first semester examinations cannot be declared. Earlier, the petitioners were allowed to appear in the final examinations of first semester only on the medical ground, and despite due sympathy being shown to them, they again failed to appear in the internal examinations for the second semester.

While continuing with her arguments, she submits that for the second semester examinations, the petitioners were granted permission to appear, however, petitioner no.1 did not appear in examination of two subjects, and petitioner no.1 did not appear for examination of three subjects, out of the total five subjects.

She further submits that in order to appear for the third semester examinations, as per Regulation 6.1(b) of Panjab University Calendar Vol.-II, the students are required to clear at least 50% of the first and second semester examinations collectively, i.e. a minimum of 5 subjects, however, both the petitioners, do fulfil such condition.

Therefore, they are ineligible to appear in third semester examinations.
