1. Appellant Sarabjit Singh has filed appeal against impugned order dated 17.07.2025 passed by learned Additional Sessions Judge, Jalandhar, whereby anticipatory bail application filed by appellant has been dismissed in FIR No. 154 dated 10.07.2025 under Section 75, 79, 351(2) of Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’) and Section 3(1)(w)(i) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short ‘SC/ST Act’) registered at Police Station Kartarpur, District Jalandhar (Annexure A-3).
2. As per the facts of case, complainant/respondent No. 2 filed written complaint against Dr. Sarabjit Singh, SMO, C.H.C. Kartarpur, with allegations of an attempt to commit rape, using casteist remarks, hurling dirty abuses to her and entire SC community, intimidating her and causing threat to her life and property.
Complainant alleged that she was serving as Staff Nurse at C.H.C. Kartarpur for last six years. She had clean record and was doing her duty with full dedication. At the time of filing complaint, she was posted at OOAT Centre of C.H.C. Kartarpur. There was one male Staff Nurse and one senior Madam alongwith her and they were doing alternate shifts. Her duty hours were from 08:00 am to 02:00 pm. On 28.06.2025, she reported for her duty at 08:00 am and on account of domestic problem, she left at 10:00 am and her husband suggested to take half day leave. She informed her senior Deepika Madam and handed over the charge to her. She was still on her way, when SMO Sarabjit Singh called her on her phone from Civil Hospital and she was told to meet him in his office. She tried to explain her problem at home, but even then she was urgently called. On the way she called her husband and asked him to accompany her. They went to Civil Hospital and also informed her senior Deepika Madam. She left her husband outside the office and went inside the office of SMO Sarabjit Singh alongwith Deepika Madam. One Amit Verma was already present there. SMO told Deepika to go out as she was not called by him. He wanted to talk to her (complainant) in private. After some time, Amit Verma also left room. His Peon Kajal came inside who was told to go outside and to ensure that nobody enters the room. Complainant has narrated the incident when she was told to come inside his small restroom, built adjoining to his office. Initially, she refused to go inside. He insisted time and again and by trusting him, she went inside the room. He bolted the room from inside and started touching her in an inappropriate manner. She stopped him and requested him not to behave in this manner, but he did not listen. He started abusing her by naming her caste. He further stated that she was lucky that he being Jatt was going to have physical relations with her. He tried to remove her clothes but she resisted. Finally, she was told to go out and next time she should come prepared. She suddenly came outside the office and his Peon Kajal started laughing at her. She disclosed everything to Deepika Madam. She was shocked and terrified. Deepika Madam suggested her not to disclose anything to her husband or family members. She also suggested to see a psychiatric and get medicine. Finally, she decided to file this complaint.
3. Learned counsel for appellant argued that allegations levelled against him are false and without any basis. As per version of complainant, said incident took place on 28.06.2025 and FIR has been lodged on 10.07.2025. All allegations levelled against him are false.
