1. Petitioners – Baljit Kaur and Amritpal Singh have filed this petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.0067 dated 13.05.2025, under Section 115(2), 74, 296, 351(2), 3(5) of BNS 2023 (Section 117(2) and 238 of BNS 2023 were added later on), registered at Police Station Bhargo Camp, District Police Commissionerate, Jalandhar.

As per facts of the case, prosecutrix ‘B.K.’ gave her statement that her husband Satnam Singh was to pay Rs.5,000/- to Kulwant Singh alias Laddi and for this reason he was making calls on the phone of her sister-in-law Rajni Bala. On the same day i.e. 09.05.2025 at about 7:00 PM she along with her husband Satnam Singh and younger son Amritpal Singh aged about 10 years went to Bajwa Dairy. Kulwant Singh alias Laddi and his wife Baljeet Kaur were present there and they started checking the account. During this, Kulwant Singh alias Laddi and his wife got annoyed and started hurling abuses and threatened them. Kulwant Singh alias Laddi or his wife called Sabbi brother of Kulwant Singh alias Laddi. Kulwant Singh alias Laddi was carrying hockey in his hand, Sabbi armed with rod or hockey attacked them. Sabbi gave blow with rod/hockey on the head of her husband which hit on the left side of his face and he fell down and became unconscious. Baljeet Kaur hit some sharp article on her husband near wrist of his left arm. Sabbi and Laadi with intention to kill her gave blows with their respective weapons. She also fell down. Sabbi gave rod blows which hit on his left hand and right knee. Her daughter Simranpreet Kaur also reached on the spot and tried to rescue them. Kulwant Singh alias Laddi gave hockey blow which hit on her head. Baljeet Kaur also tried to give a blow with some sharp article. In this attack all of them received injuries. Kulwant Singh alias Laddi and Sabbi also caught hold of her shirt and dragged her. They outraged her modesty. Her sister-in-law Sarabjeet Kaur also reached on the spot. Finally, they were taken to Civil Hospital Jalandhar. With these allegations, present FIR has been registered.

3. Learned counsel for petitioners argued that allegations levelled against them are false and without any basis. On the statement of Kulwant Singh alias Laddi, cross version has been recorded vide G.D. No.30 dated 20.05.2025 under Sections 332(c), 118(2), 324(2), 296, 351(2), 35(3), 3(5) of BNS 2023. In this occurrence, petitioner Baljit Kaur also received injury. Copy of her MLR is Annexure P-2 and photographs of the injury are Annexure P-3. Representation was given to the Commissioner of Police, Jalandhar which is Annexure P-4. Anticipatory bail application filed by Baljit Kaur was declined on 22.05.2025 (Annexure P-5) and anticipatory bail application filed by Amrit Pal Singh along with co-accused was declined vide order dated 22.05.2025 (Annexure P-6). Petitioners are ready to join the investigation as and when required. Therefore, their anticipatory bail petition may be allowed.

4. Bail petition is opposed by learned counsel representing State. Detailed status report has been filed. It is pointed out that weapons of offence are yet to be recovered. As per copy of MLR of Balwinder Kaur (Annexure R- 1) she suffered 05 injuries, Satnam Singh (Annexure R-2) he suffered 02 injuries and Simranpreet Kaur (Annexure R-3) she also suffered 02 injuries. Copy of MLR of petitioner Baljit Kaur is also annexed as Annexure R-6. It is argued that petitioners are yet to join investigation.
