1. Petitioner Lovepreet Singh has filed petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in case FIR No.142 dated 13.11.2024 under Section 137(2), 87 and 60 of Bharatiya Nyaya Sanhita, 2023, registered at Police Station Sadar Patti, District Tarn Taran.
2. As per the facts of case, complainant ‘G S’ gave his statement that he is father of two children. His daughter ‘M K’ was studying in 10+2 at ITI College, Bhagwanpur. She was born on 22.12.2007. On the night of 06.11.2024, he along with the family went to sleep after dinner. He woke up at 11:30 p.m. and noticed that his daughter was not on her bed. They started searching for her at their own level and on inquiry, came to know that Roshanpreet Singh along with his brother Lovepreet Singh enticed away his daughter on the pretext of marriage. With these allegations, present FIR has been registered.
3 Learned counsel for petitioner argued that allegations levelled against the petitioner are false and without any basis. The daughter of complainant and Roshanpreet Singh had filed CRWP-12560-2024 seeking protection of their life and liberty (Annexure P-3). In the meantime, present FIR was lodged. The alleged victim and Roshanpreet Singh were in live-in relationship with each other. Present petitioner has nothing to do with their personal life. He has already joined the investigation in pursuance of order dated 15.10.2025 and is still ready to abide by the terms and conditions of bail order.
4. Status report filed confirming the allegations detailed in the FIR. It is confirmed that it was Roshanpreet Singh who enticed away the victim, whereas present petitioner is the brother of Roshanpreet Singh. He is not involved in any other criminal case. Learned counsel representing state on instructions of ASI Kulvinder Singh confirmed that petitioner has joined investigation and he is not required for any other purpose.
5. I have considered the aforesaid factual position. Main allegations are against Roshanpreet Singh. Present petitioner is the brother of main accused who has already joined the investigation. No purpose would be served by keeping him behind the bars. He is ready to cooperate with the investigating agency. Therefore, without expressing my mind on merits of the case, anticipatory bail petition filed by petitioner Lovepreet Singh is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
6. Pending application(s), if any, also stands disposed of accordingly.
