1. Prayer in the present petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is for grant of anticipatory bail to the petitioner in case FIR No.107 dated 24.06.2025, under Sections 80 and 316(2) of BNS, 2023, registered at Police Station Model Town, District Police Commissionerate.
2. The contents of FIR are reproduced hereinafter.
“Statement of Upendar Parshad son of Late Chandrika Sharma resident of Village Bajitpur Bharthu, District Jehanabad, Bihar, Age about 72 Years, Mob. No. 80847-xxxxx, 82279-xxxxx. 1 hereby state that I am permanent resident of afore-mentioned address and I have retired from Inspector Rank Jharkhand Police. I have three children. My youngest daughter Ananya Sunaina was of about 32 Years of age and she was residing in rented accommodation at House No. 1474-D, Model Town Extension, Ludhiana and she was working at the office of F.C.I. as Grade-2 Officer. Marriage of my daughter xxxx was solemnized about two years ago with Rahul Kumar son of Radha Mohan Sharma resident of Bank Colony, Road No. 01, Opposite Shree Nidhi Apartments, Near Chimni Bhatta, Post Office Aditpur, Jamshedpur, Jharkhand. On dt. 21.05.2025 police party informed us that my daughter xxxxx has committed suicide by hanging herself in one room of her rented house. Thereafter, on dt. 22.05.2025 we came at Ludhiana and police got conducted post-mortem of my daughter xxxxx at Civil Hospital Ludhiana and after post-mortem police registered DDR No. 12 Dated 22.05.2025 U/s 194 BNSS on the basis of statement of my son Rajeev Ranjan. Today I alongwith my relative have come to you. I and my family members have enquired about the sudden suicide committed by my daughter xxxxx and we have come to know that my daughter xxxxx's husband Rahul Kumar, father-in-law Radha Mohan, mother-in-law Radha Devi residents of Bank Colony, Road No. 01, Opposite Shree Nidhi Apartments, Near Chimni Bhatta, Post Office Aditpur, Jamshedpur, Jharkhand, her sister-in-law (nanad) Priya, Priya's husband Krishan Kumar Pandey residents of Bagbera Colony Road, Quarter No. 184/2/3, Jamshedpur, Jharkhand have abetted my daughter xxxx to commit suicide by harassing her for dowry. Rahul Kumar was giving severe harassment to my daughter for dowry. Rahul Kumar was demanded money and other items from my daughter xxxxx. My daughter xxxxx had also told this to us. It is pertinent to mention here that at the time of marriage of our daughter we had gifted silver/gold etc. which are in the custody of my daughter's in-laws family members. At the instance of my daughter's husband Rahul Kumar and her other in-laws family members I had transferred Rs. 5,00,000/- from my A/c No. 10887190519 of S.B.I. Bank on dt. 04.09.2023 vide Cheque No. 947829 and had transferred Rs. 6,00,047/- on dt. 11.09.2023 vide Cheque No. 947830 to Jewelry Shop Reliance Retail Limited, Jamshedpur. I hereby produce copy of bank statement before you. Besides this, I had transferred Rs. 41,000/- from my A/c No. 72080100169552 of Bihar Gramin Bank in the account of my son-in- law Rahul Kumar, whose bank statement I hereby produce before you. Besides this, I had withdrawn Rs. 1,00,000/- from my Account ID No. 1406093849 of Post Office on dt. 11.07.2023, Rs. 1,50,000/- on dt. 28.07.2023, Rs. 2,50,000/- on dt. 28.08.2023, Rs. 4,00,000/- on dt. 03.11.2023, Rs. 2,50,000/- on dt. 28.11.2023 and Rs. 1,00,000/- on dt. 05.12.2023 in cash and had paid total Rs. 12,50,000/- to my son-in-law Rahul Kumar and his family members.
