1. The present petition has been preferred by the petitioner under

Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS”)

for grant of regular bail in case arising out of FIR No.22 dated 27.01.2025

registered under Sections 318(4), 336(3) and 338 of the Bharatiya Nyaya

Sanhita, 2023 (for short “BNS”) [Section 340(2) and 61(2) of BNS added later

on] at Police Station Civil Line, District Sonipat.

2. The aforementioned FIR was registered on the basis of the

complaint filed by the complainant Prahlad alleging that he had been introduced

with the present petitioner by his co-villager Harish. The petitioner had created

trust with the complainant and money transactions had started between them.

The petitioner had induced him to part with a sum of Rs.12 lakhs on the pretext

of entering into a partnership in business of petrol pump and also for the purpose

of getting issued a licence for gun in his favour. He had even induced his

friends Kapil and Pardeep to part with sum of Rs.3,50,000/- for the purpose of

getting gun licence issued in their favour as well. He had given them some slips

regarding moving application for issuance of arm licences, however,

subsequently the complainant came to know that those are forged and fabricated

receipts. He also came to know that the petitioner had cheated several persons

in the similar manner.

3. After registration of FIR, investigation proceedings were initiated.

The petitioner was arrested on 05.04.2025. On interrogation, he suffered

disclosure statement admitting his involvement in the crime and got recovered

some money, cellphone in which the screenshots of fake slips of arm licences

were saved, one laptop and some gold ornaments. During the investigation, it

was revealed that the petitioner had duped the friends of the complainant and a

sum of Rs.14 lakhs by making some representations as made to him. The co-

accused Harish was also arrested subsequently. Investigation now stands

completed.

4. It is argued by learned counsel for the petitioner that he has been

falsely implicated in this case. A false recovery has been planted upon him.

The subject offences are triable by Magistrate. He is in custody for a period of

over 09 months and 24 days. He is not required for further investigation. The

trial is likely to take time to conclude as only 02 out of 29 prosecution witnesses

has been examined so far. His involvement in other cases cannot be considered

to be a reason for denying benefit of bail to him. It is, thus, argued that he

deserves to be released on bail.

5. Status report and custody certificate have been filed by respondent-

State. It is argued by learned State counsel that the allegations against the

petitioner are serious in nature as not only he induced the complainant and his

associate to part with huge amount of money but also committed offences of

forgery and use of forged documents by issuing false and fabricated slips

regarding moving applications for issuance of arm licences. He is a habitual

offender as two more cases of similar nature are pending against him. There are

chances of his committing similar offences, if extended benefit of bail. It is,

therefore, argued that the petition does not deserve to be allowed.

6. This Court has heard the rival submissions made by counsel for

both the parties.
