The present writ petition has been filed under Articles 226/227 of the Constitution of India for the issuance of a writ in the nature of Mandamus directing the respondent No.2 to promote the petitioner from the post of Accountant to the post of Assistant Manager with effect from 13.08.2025, i.e., the date on which his juniors were promoted. The petitioner further seeks the grant of all consequential benefits arising therefrom.

Learned counsel for the petitioner inter alia contends that the petitioner was appointed as a Clerk-cum-Data Entry Operator on 17.12.2012 following due procedure and was posted at the respondent No.3-Branch. Owing to his satisfactory work and conduct, he was promoted to the post of Accountant on 06.03.2018, a position he has held laboriously until the present date.

It is submitted that while in service, the petitioner suffered a sudden seizure and was subsequently diagnosed with a complicated chronic disease, namely “CVA (Cerebrovascular Accident)-® MCA (Middle Cerebral Artery) infarction,” as evidenced by a certificate dated 20.03.2024 issued by PGIMER, Chandigarh (Annexure P-1). The petitioner remained admitted for treatment for several months but was declared fit to resume his duties by the concerned medical authorities on 21.06.2024 (Annexure P-2).

4. Upon being declared fit, the petitioner immediately rejoined his duties and continued to serve the Respondent-Bank to the best of his abilities. However, it is submitted that the Respondent-Bank became reluctant to continue his services following his diagnosis. This reluctance culminated in the issuance of O
