1. Present petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the petitioner in case FIR No.67 dated 25.9.2024 under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023 , registered at Police Station Ajitwal, District Moga.

2. The case set up in the FIR in question (as set out in the present petition by the petitioner) is as follows:-

‘Statement of Gurpreet Singh alias Soni son of Jagtar Singh son of Jai Singh, resident of Bughipura, tehsil and district Moga, age about 32 years, mobile number 75278-17029, stated that I am a resident of the above address. My mother Harpal Kaur is about 53/54 years age. My mother's marriage with my father Jagtar Singh took three place about 35 years ago.

brothers, I am the eldest, and younger than me are Sandeep Singh and Nirmal Singh. We all are married. Our father Jagtar Singh was addicted to consuming alcohol, due to which my mother and father often used to quarrel and fight with each other, because of which, We are being fed up, my mother Harpal Kaur has been living in a separate rented house for about the last 15 years. However, my father Jagtar Singh lives with me in village Bughipura. My mother kept living rent at different places. Now we have come to know that my mother Harpal Kaur for about the last 4 years was living on rent in village Ajitwal, Kalu Ki Patti, in Manpreet Singh son of Satvinder Singh, resident of Kokri Kalan's house, in a side room number 1 at Ajitwal. We also knew that my mother Harpal Kaur had illicit relations with a man named Manpreet Singh alias Mana alias Mani Brar, son of Malkiat Singh, resident of Rupa Patti, Rode, tehsil Baghapurana, district Moga, due to which we used to stop my mother from doing such acts. Poday dated 25.09.2024, at about 7.00 AM, Baljit Kaur wife of Paramjit Singh, resident of Ajitwal, who lives on rent in the room adjacent to my mother's room, informed me on my phone that on 24.09.24 at about 8.00 PM at night, Manpreet Singh alias Mana alias Mani Brar had come on his motorcycle to my mother of Gurmel Harpal Kaur and he was beating my mother and was holding her head and hitting it against the wall, whereupon we reached the spot and I along with Inderjit Singh son Singh, resident of Ajitwal, stopped him from doing so, after which both of them stopped fighting and quarreling, and we went to our respective homes. Today in the morning we came to know that your mother has died, and Manpreet Singh alias Mana alias Mani Brar today dated 25.09.24 at about 4.00 AM in the morning took his motorcycle and left. When I, along with my maternal Uncle Sarwan Singh son of Karnail Singh, my brother Nirmal Singh, and other relatives, came to the house and saw, the dead body of my mother was lying on the bed in room number 1. The death of my mother has occurred due to the beating inflicted by the said Manpreet Singh alias Mana alias Mani Brar. The reason for this enmity is that Manpreet Singh alias Mana alias Mani Brar suspected that my mother had illicit relations with some other person as well. Because of this, Manpreet Singh alias Mana alias Mani Brar beat my mother and caused her death. Today, when I along with my maternal Uncle Sarwan Singh son of Karnail Singh, resident of Dhudike, and other relatives was coming to the police station to get legal action initiated, you met us near the overbridge on Ajitwal Main G.T.
