CRM-5155-2026 Learned counsel for applicant/petitioner has filed an application for placing on record medical reports as Annexures P-7 and P-

8.

Perusal of the Annexure P-7 shows that it is the prescription slip wherein pain B/L knees are recorded and some medicines are prescribed; Annexure P-8 is also the eye check up slip and prescription for glasses along with some documents of Mr. Ramesh Lal which are not relevant, thus the same are not required to be taken on record for the disposal of the instant bail petition.

Application is, accordingly, declined.

1. Petitioner Rani Devi has filed instant petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.40 dated 08.05.2025 under Sections 76, 115 (2), 351 (2), 3 (5) of Bharatiya Nyaya Sanhita, 2023 registered at Police Station Shahpur Kandi, Pathankot.

2. As per facts of the case, complainant Meena Kumari gave her statement that on 03.05.2025 at about 8.30 am, she was walking outside her house which is vacant plot. Ganesh Dutt, Ramesh, Roop, Bishan, Ashwani and Mehar were standing there. Ganesh Dutt raised a lalkara to teach her a lesson who considered her a senior lawyer. He caught hold of her and Ramesh snatched her phone. Roop pulled her duppata whereas Bishan pulled her hairs She tried to escape. Ganesh Dutt humiliated her and had torn her shirt from the shoulder and touched her in an inappropriate manner. She came home. At about 9 am, Ganesh Dutt holding a sickle, Ashwani holding iron chain, Mehar, Parveen Kumari, Rani, Kausalya and Pushpa holding sickles in their hands came there. Roop was holding a bat in his hand and Bishan was holding a hockey stick in his hand. They break open the gate of their house and climbed on the wall. They came inside the house. Ashwani caught hold of her and threw her on the ground. Mehar, Roop Lal and Parveen caught hold of her legs. Ganesh Dutt slapped on her face. Ramesh opened her salwar. On hearing her screams, her mother Nirmala Devi and brother Ashwani came forward to rescue her. Aforesaid persons gave beating to them. Ganesh Dutt gave sickle blow from its backside which hit on the right arm of Ashwani. Ramesh gave stick blow which hit on his right wrist. Roop Lal gave bat blow towards her mother.

Ganesh Dutt and Parveen Kumari pulled her mother’s hairs and dragged her. They break open the main gate, flower pots, window and side of the wall. The reason behind this occurrence was dispute regarding plot of 5.06 marla bearing khasra No.232 (13-11) which is in their legal possession. Said persons wanted to take forcible possession of their land. With these allegations, present FIR has been registered.

3. Learned counsel representing petitioner argued that false allegations are levelled against her and other co-accused on account of dispute over the ownership of plot. During investigation vide GD No.28 dated 25.05.2025, it was found that no offence was made out under Sections 333, 324 (4), 190 and 191 (3) of Bharatiya Nyaya Sanhita, 2023. Rani Devi is old lady having various health issues. She is ready to join the investigation. Allegations qua her are false and general in nature. She will abide by the terms of bail order.

4. Bail petition is opposed by learned counsel representing State of Punjab assisted by learned counsel representing the complainant. It is pointed out that petitioner along with other co-accused is named in the FIR. Complainant and her family members were attacked by going to their house.
