SHALINI SINGH NAGPAL , JUDGE Prayer in the petition under Section 482 of Code of Criminal Procedure, (for short ‘Cr.P.C’) is for quashing of FIR No. 281 dated 06.06.2022, under Sections 420, 468, 471, 354-D, 376 (2)(n), 506 IPC, 1860 (Sections 420, 468, 471 of IPC added lateron), Police Station Model Town, Rewari District Rewari, Haryana along with final report under Section 173 Cr.P.C. and all consequential proceedings arising therefrom.

The facts:

Prosecutrix ‘K’ made a complaint to S.P. Rewari, stating that her husband died in the year 2004 and after his death, she was living in Kosli, where she was working in a private school. In 2012, she received a call from Ramesh Chauhan son of Vijay Singh Chauhan, who started calling her repeatedly. She told him not to call her as she was a widow and her in- laws objected but Ramesh Singh Chauhan paid no heed. One day, he came from Rajkot to the school where she was working and lured her on the promise of securing job for her in a good place. In the year 2013, he took her to Rajkot where he sexually exploited her on the pretext of getting a job and marriage. On 17.11.2020, Ramesh Chauhan came to her house at Housing Board, Sector-19, Rewari, committed rape against her wishes, took nude pictures and threatened to make the pictures viral if she did not make sexual relations with him. Thereafter, Ramesh Chauhan kept on committing wrongful acts till 20.11.2020. He also took her mobile phone to Rajkot, Gujarat. On 05.01.2021, Ramesh Chauhan came to Ansal Housing Board, Sector 19, Rewari, threatened to make the nude pictures viral and kept on committing wrongful acts with her till 07.01.2021. She got registered FIR No.6 of 2021, under Section 376, 506 IPC Police Station Model Town against him. Ramesh Chauhan showed her revolver, made her sign blank papers of compromise assuring to behave properly in future. After few days, he again threatened to make her nude pictures viral. On 17.03.2022, he came to her house at Housing Board, Sector-19, committed wrongful acts till 19.03.2022 under threat of making the nude pictures viral, continued exploiting her sexually against her wishes. She was living in constant fear as Ramesh Chauhan was sending her vulgar WhatApps messages, blackmailing her threatening to make viral her nude pictures. Ramesh Chauhan repeatedly committed rape against her wishes and threatened to kill her.

Legal action was thus prayed.

Learned counsel for the petitioner submits that respondent No.2-complainant was a 43 years old lady, on friendly terms with the petitioner. She frequently visited house of the petitioner and was well aware of his marital status. She had also attended marriage ceremonies of children of the petitioner. He further submits that prior to registration of the subject FIR, respondent No.2 got registered another FIR No. 6 dated 11.01.2021 under Sections 376(2)(n), 506 IPC on similar allegations. Thereafter, she started harassing and torturing the petitioner, raising demand of Rs. 50 lacs. To save his prestige, petitioner compromised the matter with her, transferred Rs. 7 lacs in her account and also gave her a flat in Ansal Town, Rewari. The said compromise was signed by brother and sister-in-law of respondent No. 2. Thereafter, respondent No.2 moved an application to SHO P.S. Model Town, Rewari, that she did not wish to take any legal action in the FIR and wanted to get her statement under Section 164 Cr.P.C. recorded.
