The present petition has been filed under Section 483 of the Bhartiya Nagarik Suraksha Sanita, 2023 seeking grant of regular bail to the petitioner in case bearing FIR No. 586 dated 29.07.2025, under Section 108 of BNS, registered at Police Station Sadar Hisar (Annexure P-1).
2. The case set up in the FIR in question (as set out in the present petition by the petitioner) is as follows:-
“Statement of Ramchander son of Dalip Singh, resident of Dobhi, District Hisar, aged 34 years, stated that I am a resident of the above- mentioned address and I work as a furniture maker. Today, on dated 29.07.2025, my uncle (Tauji) passed away due to illness. My children had gone to school in the morning. Around 9:00 AM, I asked my wife Rajbala to go to my uncle's house, to which she replied that you should go ahead and she would follow behind with her Devrani-Jethani. At around 01:00 PM, after the cremation, when I looked for my wife at my uncle's house, she was not there. Upon returning home, I found the outer door of our house locked from the inside. I called out to my wife but received no response. Consequently, I jumped over the wall from the house of my uncle's son, Ramniwas, to enter my house. I could not find my wife inside the house. When I went to the room (Choubara) built on the roof and looked, my wife Rajbala had committed suicide by hanging herself with a rope from a girder in the ceiling. I called out to my family members, then informed the police, and the police arrived at the spot. My wife Rajbala used to work in MNREGA. There, a person named Sunil, son of Nomidas, caste Dhanak, from our village, works as a Mate in MNREGA. He used to harass and trouble my wife Rajbala and follow her with bad intentions. My wife told me about this, after which I forbade her from going to MNREGA. We also complain regarding this to Sunil and his wife Sunita several times. Following this, Sunil remained fine for a few days, but a few days ago, my wife told me that Sunil was still following her and saying that he had obscene videos of her in his phone. He threatened that if she did not establish physical relations with him or did not obey him, he would make the videos viral, and then she and her husband would not be able to show their faces anywhere. On this matter, my uncle's son Ramniwas, Gama, and Subhash went to Sunil's house and told him not to do such things. To this, Sunil and his wife Sunita threatened us that if we told anyone about this, he or his wife Sunita would get us framed in a false case by filing a caste-based case. I came home and told these things to my wife, after which she became very badly frightened. I then gave her courage and submitted an application at the police post on 25.07.2025. However, at the request of the village elders, we sought time for a Panchayat at that time, but due to my uncle's illness, we could not hold the Panchayat. My wife Rajbala has ended her life by hanging herself due to being troubled and harassed by Sunil and Sunita.
My wife was forced to commit suicide by Sunil and his wife Sunita.”
3. Learned counsel for the petitioner submitted that the petitioner has been in custody since 15.08.2025 i.e. for a period 05 months and 13 days. The complainant is yet to be examined and the trial is likely to take a considerable period of time to conclude. Learned counsel further contended that the petitioner has been falsely implicated in the present case. There is no suicide note, prosecution rests on hearsay/motivated statements; the deceased was distressed by husband’s domestic harassment and not by the petitioner; alleged application dated 25.07.2025, remained unverified as there is no records/investigation on this; 04 d
