1. This first petition has been filed for grant of regular bail to the petitioner(s) in case bearing FIR No.48 dated 30.08.2025, registered under Section(s) 25 of the Arms Act, 1959, and Section 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3, 4 and 5 of the Explosive Substances Act, 1908 at Police Station State Special Operations Cell (SSOC), Amritsar (Intelligence Wing CID).

2. FIR in the present case was registered on the basis of a secret information received by Inspector Amandeep Singh on 30.08.2025. The same reads thus :-

“xxxxxxxxxx Today myself Inspector was present at police station that special informer by appearing informed that sitting in abroad gangster namely Nishan Singh son of Avtar Singh resident of Jodiyan Kalan Police Station Dera Baba Nanak District Gurdaspur now resident of U.K. and Shamsher Singh alias Shera Mann alias Honey son of Harbir Singh resident of Village Maan, Dera Baba Nanak District Gurdaspur now resident of Armenia, who are wanted in criminal proceedings in Punjab. Special informer further informed that above said persons in connivance with their friends namely Sarwan Kumar son of Tilak Raj resident of Malhian Police Station Behrampur District Gurdaspur and Balwinder son of Somraj resident of Jakrian Police Station Dinanagar District Gurdaspur and other unknown friends have formed a group and Nishan Singh and Shamsher Singh alias Shera while living abroad through their close friends sitting in Pakistan through Indo-Pak border have supplied a consignment of arms, ammunition and explosives to their friends Sarwan Kumar and Balwinder. Special informer further informed that today above said Sarwan Kumar and Balwinder while taking the weapons and explosives are moving near Adda Mudhal, Batala-Amritsar road for conducting some criminal activity. If search operation may be conducted in the area with a planned manner, then Sarwan Kumar and Balwinder can be restrained from conducting some big criminal activity by apprehending them alongwith the illegal weapons and explosives. That the received information is true and reliable for proceeding, which immediately conveyed into the notice of senior officials. Commission of offence under Section 25 Arms Act, 61(2) BNS, 3,4,5 Explosive Substances Act is found from the information received. Therefore, ruqa by writing for registration of FIR is sent by hand of Senior Constable Jagjit Singh 5/447. FIR may be registered.”.

It is contended that consequent upon registration of the FIR, two persons namely Sarwan Kumar and Balwinder were apprehended by the Police and one Pistol alongwith one hand grenade each was recovered from them. Counsel for the petitioner contends that during the course of investigation, disclosure of Balwinder was recorded wherein he alleged that he had procured the weapons from Jaskarandeep Singh @ Karan (petitioner herein), whereupon the latter was taken in custody on 10.09.2025. It is submitted that no recovery of any nature whatsoever has been effected from the petitioner or at his disclosure from any other person. It is submitted that disclosure was recorded only to the effect that two persons, namely Shamsher Singh @ Shera Maan @ Honey (resident of Armenia) and Nishan Singh (resident of U.K.) are the king pins in the entire episode. He contends that there is no evidence which establishes the link of the petitioner with Shamsher Singh @ Shera Maan @ Honey and Nishan Singh. It is submitted that the trial is yet to commence and 14 witnesses are also to be examined.

He contends that the petitioner does not suffer any criminal antecedents.
