1. Prayer in the present petition is for grant of regular bail to the petitioner in a case FIR No.234 dated 29.10.2024, registered under Section 25 of Arms Act, 1959 (the offence under Section 111 of BNS, 2023 and Section 29 of Arms Act, 1959 were added on 01.11.2024 and the offences under Sections 111(2), 111(3), 111(4) of BNS, 2023 were added on 24.01.2025), at Police Station Islamabad, District Police Commissionerate Amritsar, Amritsar.

Succinctly, facts of the case are that the police party, while on patrolling on 29.10.2024 and was present at Kabir Park Chowk, Amritsar, received a secret information to the effect that Karanjit Singh @ Dhani, Jasandeep Singh @ Maya @ Shillar, Dilpreet Singh @ Dil, Chheharta and Ishmeet Singh were involved in selling the illegal weapons by bringing the same from other States. It was informed that on that day, they were waiting for delivery of weapons to their customers at Cara Wali UT Market and in case of raid, they could be apprehended along with the illegal weapons. Accordingly, a raid was conducted at the disclosed place and Karanjit Singh @ Dhani alongwith co-accused was arrested at the spot. One 32 bore pistol each was recovered from Karanjit Singh @ Dhani and other co-accused. During investigation, Karanjit Singh made a disclosure statement about the complicity of Amritpal Singh @ Sapura (present petitioner) and he was nominated as an accused and was arrested on 29.10.2024. The petitioner approached the Court of learned Additional Session Judge, Amritsar, praying for grant of bail, however, after hearing counsel for the parties, the learned Additional Sessions Judge, Amritsar declined the same vide order dated 12.01.2026. Hence being aggrieved, the petitioner is again before this Court praying for the grant of bail by way of filing the present second petition.

Learned counsel for the petitioner, at the outset, prays for the grant of bail to the petitioner on the basis of parity with that of the co-accused, namely, Ismeet Singh @ Rishu, Gurpreet Singh, Varinderjit Singh, Dilpreet Singh @ Dil and Karanjit Singh @ Dhani @ Kiranjit Singh. He has drawn the attention of this Court to the order dated 17.11.2025 and 23.01.2026 passed in CRM-M-60148- 2025, CRM-M-30042-2025, CRM-M-30317-2025, CRM-M-47127-2025 and CRM-M-2707-2026, respectively whereby, co-accused Ismeet Singh @ Rishu, Gurpreet Singh, Varinderjit Singh, Dilpreet Singh @ Dil and Karanjit Singh @ Dhani @ Kiranjit Singh have been granted regular bail by this Court. He submits that the petitioner is behind bars since 29.10.2024. He submits that on the basis of the parity, the petitioner deserves to be granted bail as the case of the petitioner is similar to that of the said co-accused, who has already been granted bail.

Learned State counsel has endorsed the factum of grant of bail to the co-accused of the petitioner as stated above and has not denied that the petitioner is at par with the co-accused, Ismeet Singh @ Rishu, Gurpreet Singh, Varinderjit Singh, Dilpreet Singh @ Dil and Karanjit Singh @ Dhani @ Kiranjit Singh. He has produced custody certificate of the petitioner today in the Court and the same is taken on record.

5. After hearing learned counsel for the parties and perusing the record, it is deciphered that the petitioner is behind bars since 29.10.2024. Co-accused, namely, Ismeet Singh @ Rishu, Gurpreet Singh, Varinderjit Singh, Dilpreet Singh @ Dil and Karanjit Singh @ Dhani @ Kiranjit Singh are on bail and the case of the petitioner as stated is at par with them. Custody certificate produced would show that the petitioner has completed incarceration of about 01 year, 03 months and 02 days 0
