AMARJOT BHATTI, J.

1. Petitioner Simran Deep Singh has filed petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in case FIR No. 60 dated 11.10.2025 under Section 74, 77, 78, 65(1), 64(1), 62 of Bharatiya Nyaya Sanhita, 2023 and Section 4, 8, 12 of POCSO Act and Section 66-E, 67 of Information of Technology Act, 2008 registered at Police Station Women Fatehabad, District Fatehabad.

2. As per the facts of case, prosecutrix ‘K’ gave her statement that she was studying in 12th class in Government Senior Secondary School. She came in contact with Simran Deep, who used to live in their neighbourhood. He used to come to their house to fetch milk. They started talking to each other and also used to video call. After some time, he started putting pressure on her to come on video call by removing her clothes. He threatened her. Initially, she did not agree. Under pressure, she made a video call as per his desire and without her knowledge, he recorded the said video call. He started blackmailing her and even viral the said obscene video, which came on mobile phone of her uncle Amarjit. Her uncle disclosed this fact to her father and matter was reported to police.

3. Learned counsel representing petitioner denied the allegations. He argued that petitioner did not prepare any objectionable video nor viral the same. Without considering the aforesaid factual position, his anticipatory bail application was declined by learned Additional Sessions Judge-cum-Special Judge, Fast Track Court, Fatehabad vide order dated 04.11.2025 (Annexure P-2). He has already joined investigation on 02.11.2025 and handed over his mobile phone. He is still ready to join investigation.

4. Status report filed, confirming the facts narrated in FIR. Along with status report, there is statement of victim recorded before Magistrate (Annexure R-1). Statements of other witnesses recorded during investigation are Annexures R-3 and R-4. Learned counsel representing State also confirmed that petitioner had joined investigation and also handed over his mobile phone. However, considering the gravity of offence, anticipatory bail petition of petitioner is opposed.

5. I have considered the arguments and have gone through the record carefully. Victim has levelled serious allegations against petitioner. It is claimed that he prepared obscene video and viral the same. Matter is still under investigation. It cannot be ignored that petitioner joined investigation and cooperated with Investigating Agency. He also handed over his mobile phone to police. At present, no recovery is to be effected from him. He is still ready to abide by terms of bail order. Considering the aforesaid factual position and without expressing my mind on the merits of case, present anticipatory bail petition filed by petitioner is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.

6. Pending application(s), if any, also stands disposed of accordingly.
