AMARJOT BHATTI, J.
1. Petitioner Harjit Singh has filed petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in case FIR No. 16 dated 18.02.2025 (Annexure P-1) registered under Section 66(C), 67, 67(A) of Information Technology Act and Section 419, 468, 354-A, 120-B IPC at Police Station Ladhuwal, District Police Commissionerate Ludhiana.
2. As per the facts of case, complainant ‘KK’ gave her statement that on 04.07.2023 at night time, she received a call from mobile phone no. 98143-24xxx on her mobile phone no. 9876436xxx which she did not pick. On the next day, in morning when she called on that number, person on other side stated that she had sent a request. She told him that no such request was sent by her and on this, he sent her a screenshot of his mobile phone, showing ID of would be her daughter-in-law along with her photo and with obscene comment (paid sex). Thereafter, she received calls from Instagram. Complainant alleged that somebody was trying to spoil their image in society and is using fake ID. With these allegations, present FIR was registered and names of present petitioner Harjit Singh and Vivek Kumar cropped up during investigation.
3. Learned counsel representing petitioner argued that he is falsely implicated in this case. Even otherwise, he joined investigation when bail application was filed before learned Additional Sessions Judge, Fast Track Special Court, Ludhiana. Even at present matter has been compromised. Copy of compromise is Annexure P-2 and on that basis, separate petition has been filed for quashing of FIR bearing CRM-M- 55867-2025. Copy of order dated 08.10.2025 is Annexure P-3. Petitioner is ready to abide by terms of bail order.
4. Ms. Muskan Gupta, Advocate appeared on behalf of respondents No. 2 and 3 and confirmed the factum of compromise. However, learned counsel representing State pointed out that during investigation, it was revealed that mobile phone no. 9914481xxx was in the name of Harjit Singh and mobile phone no. 9872745xxx was in the name of Vivek Kumar. However, it is confirmed that present petitioner joined investigation on 30.12.2025 and he is not required for further investigation. 5. I have considered the aforesaid factual position. Name of present petitioner cropped up during investigation. At present, petitioner has referred to a compromise deed (Annexure P-2) on the basis of which CRM-M-55867-2025 has been filed seeking quashing of present FIR (Annexure P-3). Aforesaid case will be decided on its own merits. So far as petitioner in present case is concerned, he has joined investigation and is not required for any other purpose. No purpose would be served by sending him behind the bars. Therefore, without expressing my mind on the merits of case, present anticipatory bail petition filed by petitioner is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
6. Pending application(s), if any, also stands disposed of accordingly.
