1. By way of the present petition, the petitioner is seeking regular bail in case FIR No.90 dated 11.04.2025 registered under Sections 109(1), 3(5) and Section 25 of Arms Act at Police Station Civil Line, District Kaithal. 2. Learned counsel for the petitioner contended that the present petitioner has been falsely implicated in the present case as the petitioner is not named in the present FIR. He was nominated on the basis of disclosure statement of co-accused. He is in custody since 06.09.2025. He was falsely implicated in a case FIR No.222 dated 11.04.2025 as petitioner after his working hours was just going to drop off his friend i.e. co-accused to his village. The petitioner has already been released on regular bail in aforesaid FIR No.222 dated 11.04.2025. Thus, learned counsel prayed for grant of bail to the petitioner.
3. Status report by way of an affidavit of Sh. Gurwinder Singh, HPS, Deputy Superintendent of Police, (AEC) Kaithal, has been filed by learned State counsel and the same is taken on record. Learned State counsel submitted that the allegations against the present petitioner is that he had played an active role in the commission of offence. He acted as a key link between the main conspirator Manish Kumar @ Kaka Rana (operating from abroad) and the ground level executors. Petitioner facilitated the criminal conspiracy by introducing co-accused Abhijot @ Abhi to Sukhwinder @ Bunty and Vishal and by establishing and maintaining direct communication with Kaka Rana through ‘Whatsapp’ and ‘Instagram’ using his mobile number and his instagram ID. He knowingly agreed to work for the gang, received monetary benefits, and actively participated in planning the firing incident. On the instructions of Kaka Rana, the present petitioner accompanied Abhijot @ Abhi to Ismailabad Bridge, where a firearm was procured through an unidentified associate, and thereafter joined in briefing the co-accused about the plan. He further participated in identifying the target house through Aslam at Kaithal, thereby facilitating the execution of the offence dated 09.04.2025, clearly establishing his conscious involvement, criminal intent, and participation in the crime. The petitioner is a habitual offender and is involved in 2 more cases.

Keeping in view the facts and circumstances of the present case; the contention raised by learned State counsel, that allegation against the petitioner is that he is actively participated in the commission of serious offence i.e. attempt to murder and is involved in two more cases, this Court finds no merit in the present petition, hence, the same is dismissed.
6. Nothing observed hereinabove shall be construed to be an expression of opinion by this Court on the merits of the case.
7. Pending miscellaneous application(s), if any, stands disposed of accordingy.
