1. Petitioner Chainchal Singh @ Chanchal Singh has filed instant petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.220 dated 30.10.2024 under Sections 132, 87 of BNS (Section 132 of BNS deleted and Section 137 (2) of BNS added vide GD No.10 dated 31.10.2024) registered at Police Station Lopoke, District Amritsar.

2. As per facts of the case, complainant ‘JK’ gave her statement that she is widow lady mother of two children. Her elder daughter ‘RK’ is about 17 years of age. On 25.10.2024 she has been enticed away by unknown person by giving her allurement of marriage.

During investigation, complainant along with the victim appeared before the investigating officer on 09.01.2025. Victim refused for her medical examination. Her statement was recorded under Section 183 Bharatiya Nagarik Suraksha Sanhita, 2023. Investigation is going on.

3. Learned counsel for the petitioner argued that allegations levelled against the petitioner are vague and without any basis. He is not named by the complainant or the victim. Other co-accused Rajwinder Kaur has been granted anticipatory bail by the Coordinate Bench in CRM-M- 32948-2025 vide order dated 20.06.2025 (Annexure P-3) and Gurjit Kaur has been granted anticipatory bail by the Coordinate Bench in CRM-M- 32483-2025 vide order dated 02.07.2025 (Annexure P-4). Petitioner has already joined the investigation in pursuance of order dated 04.11.2025. He is still ready and willing to join the investigation as and when required.

Therefore, his anticipatory bail petition may be allowed.

4. Bail petition is opposed by learned counsel representing State of Punjab. It is pointed out that victim in this case is minor who was enticed away by Mandeep Kaur and Kaka Singh. She was kept in the house of Rajwinder Kaur and Gurjit Kaur. There are specific serious allegations against the petitioner and co-accused. Statement of the victim recorded under Section 164 Cr.P.C. is Annexure R-1/T. It is conceded that as per the directions of this Court, petitioner has joined the investigation.

5. I have considered the arguments and have gone through the record carefully. It is matter of record that co-accused Rajwinder Kaur and Gurjit Kaur were granted anticipatory bail as referred above by the Coordinate Bench. Present petitioner was granted interim relief and in pursuance of the same he has also joined the investigation. Statement of victim was recorded under Section 164 Cr.P.C. where name of present petitioner is mentioned but no specific role is attributed to him. Petitioner has already joined the investigation. No purpose would be served by sending him behind the bars. Considering the aforesaid factual position, anticipatory bail petition filed by petitioner is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482 (2) of BNSS, 2023.

6. Pending misc. application, if any, stands disposed of.
