1. The instant petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:-

2. Complainant-Sukwinder Singh got registered FIR alleging therein that he is doing the business of transport. His uncle's son Kuldeep Singh has a factory in Village Lehra in which material for burning from the paddy straw (parali) is prepared. On 20.9.2025 in the night, he alongwith his family was preparing to sleep after locking the gate of his house. Then at about 11:00 PM, he heard the noise at the gate of his house. He saw that three persons scaled the gate and entered the house. They were having pistols in their hands and they were muffled faces. Out of them one was Kuldeep Singh @ Manak, who was known to him earlier. After entering his house, they put petrol on his swift Dzire car bearing No.PB-10FT-8680 and put the same on fire. He started raising raula. Then Kundeep Singh @ Manak fired at him with the intention to kill him. He ran inside his house and thereafter they came out from the gate and started firing. He immediately talked with the police and then all the accused ran away from the spot. He was disclosing the incident to his acquaintances and in the meantime, a worker of his uncle's son Kuldeep Singh came and disclosed that a few minutes earlier, 4-5 persons came out side his factory and fired at him due to which fire had broken in his factory. On these allegations the FIR was registered.

During investigation, accused-Kuldeep Singh @ Manak was arrested and thereafter the petitioner was also named in the present case.

Learned counsel for the petitioner argues that prime allegation of firing shot directly at the complainant-Sukhwinder Singh @ Chinda is against accused Kuldeep Singh @ Manak, who was already knowing the complainant. Subsequently, name of the petitioner was even disclosed by the said accused. As per allegation in the FIR, neither any specific role is assigned to the petitioner for causing any injury nor his name is disclosed therein. Even putting the Maruti Dzire car on fire is also not by petitioner. Except of the disclosure statement, no other substantive evidence is available with the prosecution to connect the petitioner with the crime in question. She further submits that petitioner is already inside jail for period of about six months and similarly situated co-accused Simranjot Singh @ Sierran, whose name was also disclosed by co-accused Kuldeep Singh @ Manak has already been released on bail by the Court of learned Additional Sessions Judge, Ludhiana vide order dated 23.03.2026.

4. On the other hand, learned State counsel has vehemently opposed the bail petition and submits that there are serious allegations against the petitioner.

5. This Court has heard the submissions addressed by learned counsel for the parties and has carefully perused the record available before it. The petitioner is already inside jail for the last 06 months period and need not be detained for indefinite period.

Accordingly, prayer made in the present petition is allowed. Petitioner is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaq
