1. Present petition has been filed by the petitioner, seeking grant of anticipatory bail, in case, FIR No.185, dated 09.08.2024, under Sections 420, 467, 468, 471, 120-B of IPC (new sections 318, 336, 337,

338, 61 of BNS), registered at Police Station City Nuh, District Nuh.

2. Case of the prosecution is based on complaint bearing No.756/PG/SPL dated 14.06.2024 and complaint No.644/PG/SPL dated 17.06.2024, received from the office of the Superintendent of Police, Nuh. The said complaints were filed by the complainant-Yudhister Pal Sharma, acting as General Power of Attorney (GPA) holder of Narinter Sachavirawongse, alleging that a sale deed in respect of land situated in

Village Nalhar, District Nuh, was executed on the basis of a forged GPA.

It is alleged that Narinter Sachavirawongse,, son of Late

Sohinder Singh, resident of Bangkok, Thailand, had executed a valid GPA dated 09.02.2022 in favour of the complainant-Yudhister Pal Sharma, authorising him to manage land measuring 38 Kanals and 13 Marlas situated in Village Palari and Nalhar, District Nuh. The said GPA was subsequently stamped/registered before the office of Sub-Registrar,

Gautam Budh Nagar on 04.04.2022.

The allegations further disclose that Joginder Singh, son of Gajraj Singh, resident of Village Rithoj, Gurugram, Haryana, used a forged GPA to execute a sale deed (Vasika No. 93 dated 16.04.2024) in respect of land comprised in Khata No. 8/8, Mustatil No. 12/14/1 measuring 6 Kanal 13 Marlas, situated in Village Nalhar, District Nuh, in favour of Smt. Tahira, wife of Rafiq Ahmed, and also got the mutation

entered in her name.

4. During the course of hearing, learned counsel for the petitioner submits that petitioner himself has been duped and victimised by one Robin, on whose request, petitioner agreed to act as GPA holder and executed the transfer of land in favour of Robin’s mother, namely

Tahira, wife of Rafiq Ahmed.

5. However, upon a specific query put by the Court, learned counsel for the petitioner failed to furnish any satisfactory explanation regarding the total sale consideration or the account in which such

consideration was credited.

Having considered the submissions made by learned counsel for the petitioner, allegations contained in the FIR, and the fact that, prima facie, no part of the sale consideration was transferred to the account of the actual owner, namely Narinter Sachavirawongse, it appears that petitioner was involved in the commission of the offence as an interested party, either directly or at the behest of other accused persons who ultimately benefited from the transfer of the land, and these

aspects require thorough investigation by the Investigating Officer.

7. In view of the above, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. Accordingly, present

petition stands dismissed.
