The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking setting aside of:-

i. Order dated 18.07.2024 whereby respondent No.1-

Registrar General of Societies has dismissed the appeal;

ii. Order dated 16.06.2022 whereby respondent No.2-

State Registrar of Firms and Societies has dismissed their appeal; and iii. Order dated 28.10.2021 whereby respondent No.3-

District Registrar of Firms and Societies has rejected the application filed by the petitioners.

2. The petitioners are claiming that they are founder members of Shiksha Bharti Shiksha Samiti, Sisot, Tehsil & District Mahendergarh. The society was registered with District Registrar of Societies, Mahendergarh, Haryana. The petitioner No.1 leased out his two pieces of land measuring 20 Kanals and 15 Kanals on a nominal rent to the society vide lease deed No.705 and No.709 both dated 31.05.2007. The school started functioning in 2013. A dispute erupted between the members with respect to their status. The State Registrar of Societies vide order dated 20.05.2014 held that only those persons who were members of the society on 01.06.2009 would be treated as members of the society. The said order was challenged before Registrar General who remanded the matter to State Registrar to decide afresh. The State Registrar passed fresh order dated 02.02.2016 whereby earlier order dated 20.05.2014 was reiterated.

3. The petitioners claim that respondent No.4 who was inducted as member of the society introduced her family members as members of the society with intent to usurp assets of the society. President of the society passed away on 16.06.2021 and petitioner No.1 was holding position of Vice President. They came to know that respondent No.4 has inducted her family members as members of society by forging and fabricating documents. They filed a petition before District Registrar on 12.08.2021 who vide order dated 28.10.2021 disposed of the said petition. The District Registrar held that petitioners No.1, 2, 4 and 6 were members of the society and were never removed from the membership. The petitioners No.3, 5, 7 and 8 tendered their resignation, thus, they are no more members of the society. The petitioners preferred an appeal which came to be dismissed vide order dated 14.03.2022 by State Registrar. They preferred further appeal which came to be dismissed vide order dated

18.07.2024 passed by Registrar General.

4. Learned counsel for the petitioners submits that Maman Singh- petitioner No.3, Ved Prakash-petitioner No.5 and Harpal Singh-petitioner No.7 have not submitted affidavits dated 25.02.2026. The authorities below have blindly relied upon those affidavits. The affidavits were submitted by persons other than the alleged deponents.

5. On being asked, learned counsel for the petitioners submits that aforesaid petitioners are ready to pay costs of Rs.1 lakh each, if on examination, it is found that they have actually signed aforesaid affidavits.

6. Learned State counsel submits that if directed by this Court, District Registrar of Firms and Societies-respondent No.3 would get verified genuineness of affidavits in question.

7. Learned counsel for private respondents, who on advance notice is present in the Court, submits that they do not shy away if signatures are got verified from any hand-writing expert.

8. In the wake of submissions of stakeholders, the petition stands disposed of with a direction to District Registrar of Firms and Societies- respondent No.3 to get signatures of executant(s) of aforesaid affidavits verified fr
