1. The jurisdiction of this Court under Section 483 of BNSS, 2023 has been invoked for grant of regular bail to the petitioner in case FIR No. 32 dated 26.5.2025 under Sections 74, 78, 64(2)(m), 351(3) of BNS

IPC, registered at Police Station Women, Panipat.

2. The translated version of the FIR is reproduced below:-

“To SHO, Women Police Station Panipat subject regarding Stalking, Blackmailing and six months of threatening. It is requested that I xxxxxxx daughter of late Shri Dalip Singh am resident of village Matloda. About 6 years ago my sister Manisha was married to Harish son of Dilbag resident of Agwanpur, district Sonipat. After the marriage Harish and his family started harassing my sister Manisha and now case between Manisha and Harish is pending in the court. About five years back my brother in law Harish enticed me and took me from government school Bhandari, where I was gave one studying, on motor cycle and application in the police station upon which a case under POCSO Act was registered against Harish and he was arrested also. At that time he had stolen my photographs from my phone and uploaded in his phone at that time

also stole my Aadhar card from the mobile of my sister Manisha and he asked me to make video call after I am nude and when I objected to it he threatened me saying that he will make my photos viral social media. Today 26.05.2025 at about 10:30 he called me to a hotel near Old Bus stand Panipat and said that in case I do not meet him then he will make viral my photographs on social media and I out of fear that he may not viral my photographs on social media went to Lal Bati Panipat to make him understand and said to him "Harish stopped Blackmailing me I am not afraid of you and you delete all my photos from your phone and also delete my Aadhar card from your photo otherwise I will make an application to the police station" then Harish said meet me once in the hotel and only then I will delete your photos then I said that I will not meet you in the hotel and you say whatever you want to say while standing on the road then Harish refused to delete my photos and said that I will not allow your marriage to be solemnized anywhere and wherever you will talk for the marriage I will send your photographs therefore it is requested that strict legal action may be taken against the accused and my photo and Aadhar card may be recovered. He is

harassing me to such an extent that I will have to commit suicide.”

3. Learned counsel for the petitioner inter alia submits that the petitioner has been falsely implicated in this case by the complainant- prosecutrix. In fact, the petitioner and the prosecutrix were in a consensual relationship. It is submitted that on the similar set of allegations, the prosecutrix had earlier got registered an FIR No. 178 dated 20.8.2019 under Sections 201, 354-D and 506 IPC and Section 12 of the POCSO Act at Women Police Station, Panipat against the petitioner. However, vide judgment dated 04.2.2020 passed by the learned Additional Sessions Judge, Panipat, the petitioner was acquitted in the said case. Thereafter, the prosecutrix-complainant also got registered another FIR No. 496 dated 01.12.2021 under Sections 328, 376 and 506 IPC at Police Station Israna, District Panipat against the petitioner.
