1. Prayer in the present petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), is for grant of anticipatory bail to the petitioner, in case FIR No.91 dated 27.11.2025, under Section 69 of BNS, registered at Police Station Thulliwal, District Barnala,

Punjab (Annexure P-1).

2. Vide order dated 23.03.2026, the petitioner was directed to join

investigation. The said order is reproduced hereinafter:-

“Vide order dated 10.12.2025, the following order was passed:-

"Prayer in the present petition filed under Section

482 of BNSS, is for grant of anticipatory bail to the petitioner, in case FIR No. 91 dated 27.11.2025, under Section 69 of BNS, 2023, registered at Police Station

Thulliwal, District Barnala.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the instant case by the prosecutrix, who is a married women aged 27 years and having two children, on the allegations that the petitioner on the false pretext of marriage, established physical relations with her. It is submitted that on 02.11.2025, the husband of the complainant-prosecutrix made a complaint to the police regarding the enticement of the prosecutrix by the petitioner, whereupon both the petitioner and the prosecutrix were called at the police station concerned on 03.11.2025, and were detained. He places reliance on DDR No. 24 dated 03.11.2025 (Annexure P-2). Thereafter on 04.11.2025, the petitioner as well as the complainant were produced before the learned SDM. Barnala and their statements were recorded However, on both the occasions, no allegations with regard to enticing her or developing physical relations with her, were levelled by the prosecutrix. Further, both the above incidents have also not been mentioned in the present FIR. It is also submitted that subsequently, the present FIR has been got registered by the prosecutrix only under the pressure of her husband, after a

delay of 25 days from the alleged occurrence.

Served with an advance copy of the petition. Ms.

Guramrit Kaur, DAG, Punjab accepts notice on behalf of the respondent-State and seeks time to file reply

Learned counsel for the petitioner seeks time to file an appropriate application for impleading the complainant

as a respondent- party in the present petition.

Adjourned to 13.1.2026 Meanwhile, no coercive steps shall be taken against

the petitioner."

Learned counsel for the petitioner submits that the petitioner is ready and willing to join the investigation and

cooperate.

In the meantime, the petitioner is directed to join investigation before the Investigating Agency/Officer. He shall abide by the following conditions as envisaged under Section

482(2) BNSS, 2023;-

(1) That the petitioner shall make himself available for interrogation by a police officer as and when required to do so.

(2) That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts to the case so as to dissuade him from

disclosing such facts to Court or to any police officer.

(3) That the petitioner shall not leave India without prior permission of the Court

Needless to mention that the investigating agency/officer shall continue with the investigation of the case in usual manner.”
