Defendant No.3 is in second appeal against the concurrent judgments and decrees of the learned District Courts, whereby the suit filed by the plaintiff/respondent No.1 herein for possession by way of specific performance of Agreement to Sell dated 10.03.2005, has been decreed by both the District Courts.

2. Brief facts of the case are that the plaintiff had filed a Suit for possession of the suit land total measuring 45K-8M as described in the plaint “……by way of specific performance of contract/agreement of sell 'dated 10-03-05 executed by the defendants no. 1 & 2 in favour of plaintiff with regard to the property mentioned at letter 'X' below on payment of Rs. 14,54,095/-, the balance amount of the sale consideration or any other sum found due and stamps, registration and other allied and incidental expenses through execution and registration of sale deed alongwith all rights therein, after clearing all charges and encumbrances
