This order shall dispose of two criminal miscellaneous petitions i.e. CRM-M-6640-2026 and CRM-M-6959-2026 as they arise out of the same FIR.

2. The petitioners, namely, Sunil (in CRM-M-6640-2026) and Navdeep (in CRM-M-6959-2026) seek the grant of regular bail under Section 483 of BNSS in case bearing FIR No.14 dated 26.05.2025 under Sections 409, 419, 420, 467, 468, 471, 120-B of IPC and Sections 13(1)(c)

and 13(2) of the Prevention of Corruption Act, registered at Police Station Anti-Corruption Rohtak, District Rohtak, Haryana.

3. The learned counsels for the petitioners contend that the petitioners have been falsely implicated in the present case. The primary allegations are against one Mainpal. As petitioner-Sunil is in custody since 25.06.2025 and petitioner-Navdeep is in custody since 29.06.2025, the report under Section 173 Cr.P.C. (Section 193 BNSS) stands presented but none of the 28 prosecution witnesses has been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, they are entitled to the concession of bail.

The learned counsel for the State, on the other hand, has filed status report dated 03.04.2026 in (CRM-M-6640-2026) and status report dated 03.04.2026 in (CRM-M6959-2026), which are taken on record. While referring to the said replies, he contends that Sunil received a sum of Rs.1,08,74,568/- approximately in his account from HSIIDC which was further siphoned off by other accused. So far as the petitioner-Navdeep is concerned, he received Rs.2,00,000/- in cash as his share. The allegations do not entitle either of the petitioners to the concession as prayed for. He, however, concedes that the petitioners are in custody since 25.06.2025 and 29.06.2025 respectively and that none of the 28 prosecution witnesses has been examined so far.

7. I have heard the learned counsel for the parties.

8. The veracity of the prosecution case against the petitioners and their co-accused shall be adjudicated upon during the course of the Trial.

Admittedly, the petitioners are in custody since 25.06.2025 and 29.06.2025 respectively but none of the 28 prosecution witnesses has been examined so far. Therefore, the Trial in the present case(s) is not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioners is not required.

Thus, without commenting on the merits of the case, the present petitions are allowed and the petitioners, namely, Sunil (in CRM-M-6640- 2026) and Navdeep (in CRM-M-6959-2026) are ordered to be released on bail subject to their furnishing bail bonds and surety bonds each to the satisfaction of learned CJM/Duty Magistrate, concerned.

10. In addition, the petitioners (or anyone on their behalf) shall prepare an FDR in the sum of Rs.1,00,000/- each and deposit the same with the Trial Court. The same would be liable to be forfeited as per law in case of the absence of the petitioners from trial without sufficient cause.

11. These petitions stand disposed of.

12. The pending application(s), if any, shall stand disposed of accordingly.

13. A copy of this order be placed on the files of the connected petitions bearing No. CRM-M-6959-2026 titled as ‘Navdeep versus State of Haryana’.
