1. The present revision petition has been filed for modification of order dated 16.01.2026 passed by the Motor Accident Claims Tribunal, Karnal, whereby the application moved by the petitioner for release of amount lying deposited in FDR A/c No.946408 with Canara Bank, Assandh, was partly allowed by the learned Tribunal, by directing the Bank Manager concerned to release only an amount to the tune of Rs.1,00,000/- in favour of the petitioner.

Learned counsel for the petitioner contends that at the time of decision of the claim petition, the petitioner was minor and the amount was ordered to be deposited in the shape of FDR in a nationalized bank for a period of five years or till the petitioner attains the age of majority. He further contends that the petitioner has now attained the age of majority and wants to purchase a property, for which he urgently required the money. He has placed on record the agreement to sell along with the present petition as Annexure P-4. He, therefore, prays that his application for release of entire amount be allowed and order dated 16.01.2026 passed by learned MACT, Karnal, whereby only an amount of Rs.1,00,000/- was directed to be released, be modified to the extent of release of the entire amount along with interest.

3. Mr. Abhimanyu Kalsy, Advocate, has put in appearance and filed his Power of Attorney on behalf of respondent No.3-Insurance Company. He submits that he has no objection if the present petition be allowed.

4. I have heard learned counsel for the parties and perused the case file with their able assistance.

A perusal of the file shows that the petitioner had moved an application for release of amount lying deposited in FDR A/c No.946408 with Canara Bank, Assandh, and without assessing any valid reasons and appreciating the fact that the petitioner has become major now, learned MACT, Karnal, directed the Bank Manager concerned to release only Rs.1,00,000/- in favour of the petitioner.

6. In view of the facts and circumstances of the case, the present petition is allowed. Order dated 16.01.2026 passed by learned MACT, Karnal, is modified and the Bank Manager concerned is directed to release the entire amount lying deposited in FDR A/c No.946408 with Canara Bank, Assandh, along with interest in favour of the petitioner within a period of one week from today.
