1. Petitioner seeks anticipatory bail in case arising out of FIR No.101 dated 02.06.2024 registered under Sections 451, 323, 354, 379, 34 Indian Penal Code, Police Station City-I, Abohar. This is the first petition for anticipatory bail.
2. Following order was passed on 31.07.2025:
“On the oral request of learned counsel for the petitioner, complainant-Vxxxx is impleaded as respondent No.2 in the array of parties. Let amended memo of parties be filed in the registry within three working days positively.
This petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking anticipatory bail in case FIR No.101 dated 02.06.2024 registered under Sections 451, 323, 354, 379, 34 IPC at Police Station City-I, Abohar.
Learned counsel for the petitioner inter alia submits that there was a money dispute between the petitioner and Inderjit Singh on one side and the complainant on the other side. He further submits that no injury has been inflicted by the petitioner. He further submits that co-accused, namely, Inderjit Singh has already been granted the concession of regular bail by the Court of learned Judicial Magistrate Ist Class, Abohar, vide order dated 07.06.2024 (Annexure P-2). He further submits that the petitioner is not involved in any other case and is ready and willing to join the investigation.
Notice of motion.
Mr. Anup Singh, AAG, Punjab, accepts notice on behalf of respondent No.1-State and on instructions from SI Jaiveer Singh, submits that during investigation, co-accused Inderjit Singh has been declared innocent and DVR has also been recovered from him and has been sent to the forensic science laboratory and the report is still awaited.
Let notice be served upon respondent No.2 for
31.10.2025.
In the meanwhile, arrest of the petitioner shall remain stayed. He shall join the investigation and co-operate with the investigating agency and shall not leave the country without prior permission of the Court.”
3. Learned counsel for the petitioner submits that in compliance of order dated 31.07.2025, petitioner had joined investigation.
4. Learned State counsel on instructions from HC Jagjit Singh submits that petitioner has joined investigation and is no longer required for custodial interrogation.
5. Learned counsel for the complainant opposes the prayer for anticipatory bail.
6. Petitioner has joined investigation pursuant to order of this Court dated 31.07.2025. His further custodial interrogation is not required. In the circumstances of the case, but without commenting on merits, the petition is allowed and order dated 31.07.2025, granting interim anticipatory bail to the petitioner, is made absolute, subject to the conditions laid down in Section 482(2) of Bharatiya Nagrik Suraksha Sanhita (BNSS), 2023.
