Prayer in the present petition filed under Section 483 of BNSS is for grant of regular bail to the petitioner in case FIR No.104 dated 29.07.2020, registered at Police Station Kachha Pacca, District Tarn Taran, under Section 22(c ) NDPS Act, 1985

2. Learned counsel contends that the petitioner has been in custody for 1 year and more than 7 months. He alleges false implication. The alleged recovery effected from him is 1250 tablets containing 507 grams Tramadol Hydrochloride.

Charges have been framed on 03.10.2024, however, only 2 PWs stand examined and there are still 7 more to go. He is not involved in any other case.

3. The custody certificate dated 11.02.2026, filed by the learned State counsel is taken on record. As per the same, the petitioner is behind bars for 1 year, 7 months and 4 days.

4. Learned State counsel opposes the bail on the ground that commercial quantity of contraband was recovered from the petitioner, who was arrested at the spot. However, he is unable to controvert the submissions with regard to stage of the case and the petitioner being not involved in any other case.
