1. Prayer in this petition, filed under Section 483 read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, is for grant of interim bail for a period of seven days to the petitioner in case arising out of FIR No. 92 dated 29.07.2025, registered under Sections 103(1), 115, 118(2), 126, 190, 191(2), 249(a), 351(3) and 61 of BNS, 2023 at Police Station Jui Kalan, District Bhiwani.

2. It is argued by learned counsel for the petitioner that he has been arraigned as an accused in the aforementioned FIR and is lodged in District Jail, Bhiwani. The marriage ceremonies of his sister’s sons, namely Hayance and Rohit, are to be performed on 19.02.2026. He is the only brother of his sister and has to perform certain essential rituals like Bhat ceremony in the wedding ceremonies, for which, his physical presence is required there. No prejudice shall be cause to anyone, if the petitioner is released on interim bail for a limited period for the said purpose. Hence, it is urged that the petition deserves to be allowed and the petitioner deserves to be granted concession of interim bail.

3. Learned State counsel and learned counsel for the complainant have advance notice of the petition. Learned State counsel, assisted by learned counsel for the complainant, has argued that the petitioner is the main accused, who had committed murder of victim Karan Singh by hatching criminal conspiracy with the co-accused. He has criminal antecedents as he was previously convicted in a case registered against him under the NDPS Act. His son and father are outside and they can perform the rituals related to the weddings. There are chances of the petitioner’s intimidating the witnesses, if released on bail. It is, thus, argued that the petition is liable to be dismissed.

6. The petitioner is seeking interim bail for a period of seven days on the ground of performing certain rituals in the marriage ceremonies of his sister’s sons. However, the allegations against the petitioner are grave and serious in nature. He has been arraigned as the main accused in a case involving the offence of murder. The material on record prima facie indicates his active involvement in the commission of the crime pursuant to a criminal conspiracy. It has also been brought to the notice of this Court that the petitioner has criminal antecedents and was earlier convicted in a case registered under the NDPS Act. The possibility of his influencing or intimidating prosecution witnesses, particularly in view of the nature of allegations and his antecedents, cannot be ruled out at this stage. The ground urged for grant of interim bail is to enable the petitioner to participate in marriage ceremonies and perform certain customary rituals. While the Court is not unmindful of the emotional and social importance of such occasions, it has been specifically pointed out that other adult male members of the family, including the petitioner’s father and son, are available to perform the necessary ceremonies. The said ground, therefore, does not constitute such an exceptional circumstance so as to outweigh the seriousness of the allegations and the apprehension expressed by the prosecution. Considering the gravity of the offence, the role attributed to the petitioner, his criminal antecedents and the likelihood of interference with the course of justice, this Court does not find any sufficient ground to grant the concession of interim bail. Accordingly, the petition is dismissed.
