The present petition has been filed under Section 482 of the BNSS, 2023 for grant of pre-arrest bail to the petitioners in case bearing FIR No.57 dated 29.05.2025, under Sections 118(1), 191(3), 190 of BNS, 2023 (Section 118(2) of BNS was added later on) registered at Police Station Phul, District Bathinda.
2. The FIR in the present case has been registered on the statement of Satnam Singh son of Maghar Singh resident of Ghanda Banna and the same is extracted as under:
“Statement of Satnam Singh s/o Maghar Singh, resident of Ghanda Banna, aged about 35 years, Mobile No. 98760-26820, stated that I am resident of above mentioned address and do the labour work. On dated 13.05.2025 time was about 9:00, I came to my house from outside, at that time my sister-in-law Lovepreet Kaur w/o Sukhdev Singh started staying bad names to my wife. My wife kept quiet. Then Lovepreet Kaur started abusing me. Then I told her that why you are giving abuses to me, then I told my brother Sukhdev Singh that why he do not stop Lovepreet Kaur from doing so, then Sukhdev Singh picked up quarrel with me. Sukhdev Singh put his arm in my neck and dragged me towards the street, then Lovepreet Kaur gave out a Lalkara to teach me a lesson for speaking. Then Sukhdev Singh @ Nohni armed with sword, Dilpreet Singh s/o Jagga Singh and Jagjit Singh s/o Jagga Singh both armed with Kirpan. My sister Veerpal Kaur armed with Soti, then Dilpreet Singh gave out a sword blow on the backside of my head and Sukhdev Singh gave out a sword blow from the sharp side on the back of my head. Then Jagjit Singh gave out a sword blow on my right bicep. I fell down, then Dilpreet Singh gave sword blow on my right leg. Then my sister Veerpal Kaur gave a stick blow on my back. I raised cries of 'Maar Ditta Maar Ditta'. My wife Karamjit Kaur came running, then all of them fled away the scene after riding their respective motorcycles. Then my wife make arrangements for the vehicle and got me admitted in Civil Hospital, Rampura, where doctor sahib referred me. Then my wife got me admitted in New Umeed Hospital, Bathinda where I am under treatment. Cause of the enmity is that my sister-in-law Lovepreet Kaur used to abuse me and my wife Karamjit Kaur. I used to tell my brother to stop her from her doing so. Because of this reason they in connivance with each other gave me bodily injuries. In this fight, ear rings of my wife also fell down. Action be taken against Sukhdev Singh and others.”

Learned Counsel appearing on behalf of the petitioners contends that the petitioners have been falsely implicated in the aforesaid case out of family dispute as the complainant wants to take forcible possession of the house in which the petitioners are residing. He further contends that the FIR in the present case has been got registered after delay of 16 days without giving any explanation for the same. He further contends that only simple injuries attributed to Daljit Singh with a Kirpan on the right bicep whereas even the injury attributed to Dilpreet Singh was also originally stated to be simple but later offence under Section 118(2) had been added. It is contended that the person with whom the primary dispute arose has already been granted concession of bail.

Learned Counsel appearing on behalf of the respondent(s), however, contend that the petitioner Dilpreet Singh is attributed a Kirpan blow on the back side of the head of the victim alongwith causing a sharp injury on the leg while Daljeet Singh @ Jagjit Singh is attributed a Kirpan blow on the right bicep.
