1. By way of this common order, both the aforementioned petitions are being disposed of together as they arise out of one common FIR.

2. Present petitions have been filed under Section under Section 483 of BNS, seeking regular bail in case FIR No. 36 dated 10.02.2024, under Sections 302/323/324/34 IPC, registered at Police Station Urban Estate, Hisar District Hisar.

3. As per the allegations in the FIR, Putan, Deepak, and a girl named Preeti were reportedly working together. Complainant-Rishu, was in talking terms with Preeti, which was objected to by accused-Akash, who allegedly asked the complainant to delete Preeti’s number. On that account, on 09.02.2024 at about 10:00 p.m., accused-Akash called the complainant to Jindal Chowk.

On reaching Jindal Chowk along with one Shankar, the complainant found that all three accused in the case, namely Akash, Sunny @ Shinder, and Gobind, were present, and they allegedly started fighting with him regarding his calls to Preeti. During this altercation, Putan ( deceased in the present case) and Deepak Yadav also arrived at the spot.

Further, it is alleged that when Akash and his associates were assaulting the complainant, Putan attempted to intervene. However, Akash and his associates allegedly caused injuries to Putan with a knife on the abdomen, chest, and other parts of his body. Thereafter, they reportedly fled the scene on a scooty, carrying the knife with them.

4. During the course of the trial, all the eye-witnesses, including complainant-Rishu, turned hostile. Primarily on that account, the bail petition filed by the third accused, Shivdutt @ Sunny (CRM-M- 9153-2025), was allowed by this Court, and accordingly, accused Shivdutt was ordered to be released on bail.

5. When the aforementioned bail petitions filed by the remaining two accused, namely Akash and Govind (petitioners herein), came up for hearing on 21.07.2025, the following observations were recorded:

“1. Present petitions have been filed by the petitioners, seeking grant of regular bail in case bearing FIR No.36, dated 10.02.2024, under Section(s) 302, 323, 324, 34 of IPC, registered at Police Station Urban Estate, District Hisar. 2. Learned counsel for the petitioners submits that FIR was lodged by an eye-witness, Rishu, aged 21 years, who stated therein that he used to talk with one Preeti, which was objected to, by accused Akash, who had threatened him to delete her mobile number.

As per the FIR, on the date of the incident, i.e., 09.02.2024 at around 10:00 PM, when the complainant Rishu was present at Jindal Chowk along with one Shankar, accused Akash (petitioner in CRM-M-32804-2025), Sunny (petitioner in CRM-M-9153- 2025), and Gobind (petitioner in CRM-M-32902-2025) were already standing there. Akash allegedly started a confrontation with the complainant over calling Preeti. During the altercation, Putan and Deepak Yadav also arrived at the spot. While Akash and his associates were physically assaulting the complainant - Rishu, Putan (now deceased) attempted to intervene to save him. At that moment, accused Akash and his associates allegedly inflicted knife injuries on the chest, abdomen, and other parts of the body of Putan. After causing the injuries, all the accused fled away from the scene on a scooty, carrying the weapon along with them.

3. Counsel for the petitioners further submits that during the dourse of investigation, a knife was recovered from the possession of accused Gobind, and bloodstained clothes were recovered from accused Sunny, which, as per the prosecution, may match the blood group of
