1. This common order shall dispose of the aforementioned two petitions which have arisen out of same FIR. These petitions have been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS”) seeking grant of regular bail to the petitioners in case arising out of FIR No.168 dated 17.03.2025 registered under Sections 108 and 61(2) of Bharatiya Nyaya Sanhita, 2023 (for short “BNS”) at Police Station Surajkund,

Faridabad.

2. The aforementioned FIR was registered on the basis of a written complaint submitted by the complainant-Suresh @ Tinku alleging therein that on 16.03.2025, his brother Rakesh @ Rinku and himself were assaulted by the petitioners and co-accused who were accompanied by 8-9 persons unknown to them. They had sustained injuries and went to BK Hospital, Faridabad. However, the aforementioned followed them at the hospital as well and assaulted both of them. He alleged that his brother was under immense pressure and committed suicide by hanging himself with a tree in the forest existing near Badkhai Lake. The victim had also prepared a video of the incident by

committing suicide in his mobile phone. While submitting a pendrive containing the said video, the complainant prayed for taking action in the matter. 3. After registration of FIR, investigation proceedings were initiated. Post-mortem of the dead body of the Rakesh @ Rinku was conducted. The petitioner Sonu @ Sachin was arrested on 28.03.2025 and the petitioner Arun @ Anu was arrested on 16.04.2025. Co-accused were also arrested subsequently. It was revealed that the petitioner Sonu @ Sachin, was a friend of Sonu, brother of the victim and the complainant. A dispute amongst the brothers themselves was existing qua some land and on the asking of Sonu brother of the deceased, the petitioners alongwith co-accused had extended beatings to the complainant

and the victim. Investigation now stands completed.

4. It is argued by learned counsel for the petitioners that they have been falsely implicated in this case. They are in custody since 16.04.2025 and 28.03.2025 respectively. They are not required for further investigation. There are no chances of conclusion of the trial in the near future as no prosecution witness has been examined so far. No useful purpose would be served by detaining them in custody anymore. The victim himself was a short-tempered person and patient of depression. Even if the version in the FIR was believed to be correct, there was no reason to commit suicide by the victim. The ingredients for commission of offence under Section 108 of BNS are not attracted at all in this case. Thei
