1. The present writ petition has been filed under Articles 226 and 227 of the Constitution of India seeking issuance of a writ in the nature of certiorari for quashing order dated 06.03.2024 (Annexure P-5), whereby the respondent dismissed the petitioner from service.

Learned counsel for the petitioner inter alia contends that the respondent-Shiromani Gurdwara Prabandhak Committee (hereinafter referred to as ‘SGPC’) is a statutory body created under the Sikh Gurdwara Act, 1925. The SGPC has framed Service Rules in respect of its employees prescribing their service conditions, which were duly approved by the Executive Committee vide Resolution dated 14.12.1954 and subsequently amended from time to time.

3. It is submitted that the petitioner was initially appointed on 14.12.2004 on daily wage basis, and thereafter he was granted regular appointment on fixed salary as a Sewadar on 07.12.2006 (Annexure P-1). On 22.06.2020, the petitioner was promoted as a Helper, and on 22.03.2022, he was granted the grade of the Helper (Annexure P-2). Learned counsel argues that while the petitioner was performing the duty of a Helper in Sri Darbar Saheb, Amritsar, during the course of counting of the Golak, an allegation was levelled against him of having stolen Rs.12,000/-, which came to light from the recording of the CCTV camera
