The instant second petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.) for grant of regular bail to the petitioner, in case FIR No.509 dated 05.11.2024, registered under Section 21(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Civil Line Sirsa, District Sirsa.

2. As per allegations in the present case, 261 grams of heroin was recovered from the right pocket of the lower of the petitioner.

3. Learned State counsel, produces the custody certificate dated 08.03.2026, which is taken on record. Office to tag the same at appropriate place. Copy thereof has been handed over to the counsel for the petitioner.

4. As per custody certificate, petitioner was found to be involved in 17 other cases registered under the NDPS Act and in five of those cases, he has already been acquitted, the details of which are given hereunder :-

Sr. No. FIR detail Remarks Apart from the present case, ten other cases are pending decision qua the petitioner. To sanction the plea of bail, learned counsel for the petitioner relies upon the order dated 26.11.2025 passed in CRM-M-33148-2025 whereby, the accused in that case namely, Manoj Kumar @ Moji was granted bail despite he being facing 17 other cases. The petitioner therein was found travelling in an Innova Car and from the pocket of the trouser worn by accused therein namely, Sukhbir Singh @ Sukhi, 340 grams of heroin was recovered and not from the petitioner in that case. However, noticing the facts of said case, the present case is different from the referred case.

Faced with the situation, learned counsel for the petitioner prays for withdrawal of the instant petition at this stage.

Dismissed as withdrawn at this stage.
