The prayer in the present petition under Section 483 BNSS is for the grant of regular bail in case bearing FIR No.472 dated 04.11.2022 (Annexure P-1) registered under Sections 307, 326, 324, 323, 148, 149 of the NDPS Act and Section 3 of the Prevention of Defacement of Property Act, 1985, at Police Station City Faridkot, District Faridkot.

2. The present FIR came to be registered at the instance of Sajan and reads as under:-

Statement of Sajan son of Jatinder Singh son of Satjit Singh resident of Dogar Basti Gali No.11L Faridkot, aged about 24 years, M.No.96463-45755, stated that I am resident of the above mentioned address, I am a student of BCA. Today, on my motorcycle, I was coming to Chahal road. My friend Binder Singh and Rohit Kumar son of Fakir Chand, on their motorcycle, were going ahead of me. Rohit was driving motorcycle and Binder Singh was sitting pillion rider. When we were just behind the fatak, were just equal, then it was around 11.30 AM that then on three motorcycle, Rohit alias Neela Dhobi, Backside Shaheed Bhagat Singh Park Faridkot, Sagar resident of Balbir Basti Gali No.10R Faridkot, Rahul resident of Jogia Wala Mohalla, Ringi resident of Balbir Basti, Romi resident of Kameana Gate, Karan Bachi son of Kinder Singh resident of Araiwala Road Faridkot, Happy Bola and Buldi residents of Bazigar Basti Faridkot, who were carrying kaape,swords in their hands, Neela Dhobi and Sagar were carrying pistol, by bringin equal motorcylces, they caught Binder Singh. Rohit has taken away the motorcycle, Binder fell down. Then Rohit by taking Kaapa from the accompanied boy, with the motive to hit on the head of Binder, attacked, which hit on the forehead on left side of head, while lying on the ground, Rahul with the kaapa carried in his hand, Ringi and Romi with their weapons, gave injuries, we raised alarm 'mar ta mar ta'. Upon seeing people gathering, all of them along with their weapons riding over motorcycles, ran away from the spot. We got admitted Binder Singh at Medical Hospital Faridkot, where we were going to get X-Ray of Binder then again Rohit, who was carrying kaapa in his hand, Ringi armed with sword, Romi armed with kaapa, Karan Bachi armed with kaapa, Happy Bola armed with sword, Bundi armed with Kaapa and four five more boys who were carrying swords and kaapa in their hands, came there. Karan Bachi raised alarm that Sajan and Rohit are left, let us remove their thorn also. Then Karan Bachi with the kaapa carried in his hand, hit on me with the motive to hit me, which hit me on the head. I fell down. While I was lying, all of them, gave me injuries with swords and kaapa, which hit me on left hand left arm. I raised my left hand upwards for protection then on many swords and kaapa hit on the hand, from which my little finger was cut down, I received injuried on my left and right leg upper from knee and also received more injuries on the body. I came to know later on that Rohit's left wrist has been slaughtered, the doctors are doing surgery of which. Except wrist,there are more injuries. All of them, with the motive to kill us, attacked on us. The reason for enmity is that last year on 4/8/2021, Karan alias Bachi had received injuries from us, against us FIR under Section 307 was registered, in which, I have been released on bail. The doctor has been giving us treatment. You have recorded my statement, heard and it is correct. Kindly take necessary legal action against them.
