1. The present petition has been preferred under Section 528 of BNSS, seeking quashing of criminal complaint i.e. COMA/15672/2021, dated 29.11.2021 (Annexure P-1) titled as ‘Rakesh Kumar Dhamija versus Ankur Mangla’ filed under Section 138 of the Negotiable Instruments Act, 1881 (hereinafter to be referred as ‘Act’), pending in the Court of learned Judicial Magistrate Ist Class, Ludhiana as well as the summoning order dated 10.01.2022 (Annexure P-2) passed by learned Judicial Magistrate Ist Class, Ludhiana, and all other subsequent proceedings arising therefrom.

Briefly stated, the case of the complainant is that the petitioner allegedly issued two cheques bearing No.000377 and 000378, both dated 07.09.2021, for an amount of Rs.13,00,000/- and Rs.15,50,000/-, respectively, drawn on Standard Chartered Bank, purportedly in discharge of a legally enforceable debt/liability.
