The prayer in this third petition under Section 483 Cr.P.C is for the grant of regular bail in case bearing FIR No.31 dated 18.02.2023 registered under Sections 21(c), 29, 30, 32, 50 of NDPS Act, Sections 307 & 201 IPC and Section 25 of Arms Act at Police Station Dera Baba Nanak, District Gurdaspur.
2. The present FIR came to be registered at the instance of BSF and the same reads as under:-
To, The Station house officer, PS Dera Baba Nanak (Punjab) SUB:- LODGING OF FIR REGARDING SEIZURE CONTRABAND ITMES (SUSPECTED TO BE HEROIN), ARMS AND AMMUNITIONS IN THE AOR OF BOP-DEN ROAD A COY 113 BN BSF Sir, 1. It is to inform that on 18th Feb 2023 from 0030 hrs to 06:30 hrs, the following Pers of BOP DBN Road were detailed for HIT duty at HIT No. 01 of BOP DBN Road in the Alignment of BP No. 42/25 S, 01) No. 902982145 HC-Azeem S, 02) No. 031041126 CT-M.S. Hembram and 03) No. 140703863 СТ-К Anil 2. At about 180530 hrs no. 031041126 СТ-M.S. Hembram observed suspicious movement ahead of BS fence in the Alignment of 42/25 S. On this CT-M.S. Hembram alerted the other Pers of HIT duty and fired 03 burst of 09 Rds from his personal weapon butt No.68 body No. 16912709 Further CT-M.S. Hembram also received 02 burst from counter part, sensing the eminent threat, CT-M.S. Hembram took position and again fired 06 Rds in the direction of the fire, came from counter part. On hearing the sound of fire HC- Azzem S immediately rushed to the spot and fired 02 Rds from his Insas rifle butt No. 02 body No. 16692229. In the mean time the vehicle /foot patrolling parties consisting of Offg Coy Comdr Inspr- Rajesh Kumar, CT- R.K.Meena Comma CT/Dvr 5. Channa Keshav, SI/G Revaneppa D and Post Comdr of Bop DBN Road joined the HIT Party to reinforce them and SI-Amarjit Singh also fired 05 Rds from 9 MM SMG butt No. 11 body No. 12-32511, Insp-Rajesh Kumar fired 02 Rds from 9 MM SMG butt No. 02 body No. 11- 09096 and CT-R.K. Meena also fired 03 Rds from 5.56 MM Insas rifle butt No. 78 bady No 16912372. After sometime the firing was stopped and thorough search of the area between IB and fence was carried out by strong search team. During the search following items were recovered. 01)20 pkts of contraband items suspected to be heroin. 02) 02 Pistol 01 Turkey made with 02 MAG and 01 China made CAL 30 with 04 MAG.03) 12 feet pipe 4"dia.04) 242 live Rds of 7.62 MM ball. The sample has been taken from all the 20 pkts and tested with DD Kit and the seized contraband items from all the 20 pkts found result positive for heroin. After removing packing materials of all 20 pkts contraband items contains the net weight comes 19.850 kg (01 no pkt-10.00 kg,02 no pkt-09.850 kg) All items are being handed over to Police of P.S Dera Baba Nanak, Gurdaspur, PB.(3)In view of above it is requested to lodged an FIR under 154 CrPC and as well as to carry out an investigation to nab the culprits behind the nefarious activities. A copy of the FIR to lodged may be provided to this office for our further course of action. During investigation it transpired that the petitioner along with Tarsem Singh, Jugraj Singh and Ravinder Singh used to collect the consignment of contraband from the border area after the same was thrown from the Pakistani side and after collecting the same they would deliver the consignment further.
4. The learned counsel for the petitioner contends that the petitioner had been falsely implicated in the present case. He contends that the name of the petitioner figured in the
