The prayer in this 2^nd petition under Section 483 BNSS, 2023 is for the grant of regular bail in case FIR No.98 dated 24.09.2021 registered under Sections 302, 307, 323, 324, 341, 506, 201, 148, 149, 120-B IPC at Police Station Satnampura Phagwara, District Kapurthala.

2. At the very outset the learned counsel for the petitioner has withdrawn the instant petition qua petitioner No.1-Ravi Kumar and petitioner No.3-Kulwinder Kaur @ Komal.

3. As regards petitioner No.2, he contends that he is suffering from spinal tuberculosis and multiple other medical problems including paraplegia. He has been granted the concession of interim bail by this Court vide order dated 30.04.2025. Keeping in view the medical condition of the petitioner, the interim bail be made absolute.

4. A status report dated 14.10.2025 by way of an affidavit of Bharat Bhushan, PPS, Deputy Superintendent of Police, Sub Division Phagwara, District Kapurthala has been filed on behalf of the State by the learned counsel for the State. The same is taken on record. While referring to the same, he admits the factum of the petitioner suffering from multiple ailments such as spinal tuberculosis and paraplegia along with HIV and HCV. He contends that though the petitioner is ailing, the nature of the allegations levelled against him do not entitle him to the concession of bail.

4. I have heard the learned counsel for the parties.

5. On 30.04.2025, the following order was passed:-

“Prayer in the present petition is for grant of regular bail to the petitioners in a case FIR No.98 dated 24.09.2021, registered under Sections 302, 307, 323, 341, 506, 201, 148, 149, 120-B IPC, at Police Station Satnampura Phagwara, District Kapurthala.

Learned counsel for the petitioners has submitted that petitioner No.2 in CRM-M-8639-2025, namely, Lakhvir Kumar is suffering from serious medical problem, who is not even able to perform his daily routine.

Learned State counsel has placed on record the certificate issued by the Medical Officer, Central Jail, Kapurthala, wherein, it has been observed by the Doctor that petitioner- Lakhvir Kumar is completely immobilized and he is not able to do his ordinary course of his own.

Keeping in view the serious medical condition of petitioner No.2 in CRM-M-8639-202, namely, Lakhvir Kumar, he is granted interim bail subject to his furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Duty Magistrate, till the next date of hearing.

Adjourned to 20.08.2025.

No: 6725 Date: 07/07/25 Subject:- Regarding Medical Report of inmate Lakhvir Kumar son of Jaspal Pid-653535, 42 yrs UT (Male).

Respected Sir, As per record, Lakhvir Kumar son of Jaspal (PID-653535) is lodged in Central Jail Kapurthala. He is diagnosed case of Spinal Tuberculosis with Paraplegia. He is also known case of HIV and HCV.

On 20-06-2024, the above said patient presented to Jail Hospital Central Jail Kapurthala with complaint of renal stone, he was treated conservatively and referred out to CH Kapurthala surgery department.

On 14/07/2024 above said patient presented to Jail Hospital Central Jail Kapurthala with complaint of Pain abdomen and chest pain, he was managed conservatively and referred out to CH Kapurthala in surgery department.
