1. The jurisdiction of this Court under Article 226 of the Constitution of India has been invoked for issuance of a Writ in the nature of Habeas Corpus to search and produce detenue-Chahat, major daughter of the petitioner, who has been illegally kidnapped/detained by respondents No.4 to 6.
2. Learned counsel for the petitioner has submitted that daughter of the petitioner had gone for interview on 14.05.2026 and never came back home. Thereafter, petitioner has given a missing complaint and got DDR No. 13 dated 15.05.2026 registered.
3. On notice of motion having been issued on 27.05,2026, State counsel has accepted notice on behalf of the official respondents whereas notice was issued to private respondents No. 4 to 6 to produce the detenue on the date fixed.
4. Sh. Ashok Kumar Khunger, Advocate enters appearance on behalf of respondents No. 4 to 6 and submits that alleged detenue is not with them and they are not aware about her whereabouts.
5. Learned State counsel has filed status report by way of affidavit of Gurcharan Singh, Deputy Superintendent of Police, Sub Division City-1, District SAS Nagar, on behalf of respondents No. 1 to 3 in the Court today and the same is taken on record wherein it has been stated in paras 7 to 9 that when petitioner told the Investigating Officer that her daughter is chatting with them through Google Chat, police party traced her location at Noida and raids were conducted at nearby places alongwith her parents but she was not found. Thereafter, on 20.05.2026, when petitioner informed the police that her daughter has again contacted them through Google chat, her location was found at Lucknow and police party carried out raids at Lucknow in the presence of the parents, however, again she was not found. The police officials have even associated respondent No.4 in the investigation and his tower locations and CDR were also obtained and examined, however, he was not found to have contacted the alleged detenue since the date of her having gone missing.
6. Learned State counsel further submits that police officials are making all sincere efforts to trace out the daughter of the petitioner in accordance with law.
7. In view of the aforesaid facts, the present petition stands disposed of, however, petitioner shall be at liberty to take recourse to any other alternative remedy, available to her, in accordance with law.
8. Pending application(s), if any, is/are also disposed of.
