The present revision petition has been filed impugning the judgment dated 27.10.2025 passed by the Additional Sessions Judge, Gurdaspur Taran whereby the appeal filed against the judgment of conviction and order of sentence dated 15.11.2018 passed by the Judicial Magistrate Ist Class, Batala has been upheld.

2. The FIR in the present case came to be registered on 20.10.2015. The judgment of conviction and order of sentence was passed on 15.11.2018. The appeal filed against the judgment of conviction came to be dismissed on 27.10.2025 by the Additional Sessions Judge, Batala. This revision petition was filed on 18.11.2025 and has come up for final hearing now i.e. after a period of almost 11 years having elapsed from the date of the filing of the FIR.

3. The brief facts of the case are that the accused/petitioner Mohraj Singh (hereinafter known as the petitioner) came to be convicted by the Court of the Judicial Magistrate Ist Class, Amritsar vide judgment of conviction and order of sentence dated 15.11.2018 as under:-

Offences Imprisonment Fine In default of the payment of fine
U/S 452 IPC RI for 03 years Rs.500/- SI for 10 days
U/S 325 IPC RI 03 years Rs.500/- SI 10 days
U/S 323 IPC RI 06 months Rs.500/- SI 10 days

All the sentences were ordered to run concurrently.

4. The petitioner preferred an appeal before the Court of Addl. Sessions Judge, Gurdaspur which came to be dismissed vide judgement dated 27.10.2025.

5. The aforesaid judgments are under challenge in the instant revision petition.

The learned counsel for the petitioner submits that the present case stems out of a matrimonial dispute between the petitioner-Mohraj who was married to complainant/respondent No.2/Gurjinder Kaur (hereinafter known as respondent No.2) who is currently living abroad. The petitioner does not wish to challenge his conviction but prays that his sentence be reduced to the period already undergone by him.

The learned counsel for the State, on the other hand, has placed on record a custody certificate dated 23.05.2026 of the petitioner as per which he has undergone actual sentence of 06 months and 26 days out of his substantive sentence of 03 years. He contends that the offence against the petitioner stands well established. Therefore, the present revision petition is liable to be dismissed without any reduction in sentence.

8. I have heard the learned counsel for the parties.

9. During the course of proceedings, the petitioner agreed to suitably compensate Gurjinder Kaur (respondent No.2). In furtherance of the same, the mother of respondent No.2/complainant namely, Kulwant Kaur has received an amount of Rs.1 lakh and the said fact has been documented. The same is taken on record and marked as X.

10. I have also gone through the case file. The offences against the petitioner stand established beyond reasonable doubt. Therefore, I find no merit in the present petition and the same stands dismissed.

11. As regards the sentence, admittedly, the present case emanates out of a matrimonial dispute. The respondent No.2 is already living abroad. The petitioner has undergone total custody of 06 months and 26 days out of his substantive sentence of 03 years. He has also paid a sum of Rs.1 lakh to Kulwant Kaur (mother of the respondent No.2). Therefore, while upholding the conviction of the petitioner, his sentence is reduced to the period already undergone by him i.e. 06 months and 26 days. However, the payment of fine and sentence in default of payment of fine shall remain intact.

12. The pending application(s), if any, shall stands disposed of accordingly.
