transfer of the petition filed by respondent-husband under Section 13 of

the Hindu Marriage Act, 1955 (for short ‘the Act’) bearing No.

Rani’, pending before the learned Family Court, Shaheed Bhagat Singh

Nagar to a Court of competent jurisdiction at Jalandhar.

2. CRM-M-55483-2025

Present petition has been filed by the petitioners under

Section 447 read with 528 of the BNSS 2023, for transfer of petition

bearing No. COMA/2/2024 (Annexure P-2) filed by the respondent-wife

under Section 12 of the the Protection of Women from Domestic Violence

Act, 2005 (hereinafter referred to as ‘the Act’), pending adjudication

before the learned Judicial Magistrate Ist Class, Jalandhar to learned

Judicial Magistrate Ist Class, SBS Nagar.

3. CRM-M-55504-2025

Present petition has been filed by the petitioner-husband

under Section 447 read with 528 of the BNSS, 2023, for transfer of

petition bearing No. MNT/125/21/2024 (Annexure P-3) filed by the

respondent-wife under Section 125 Cr.P.C., pending before the learned

Family Court, Jalandhar to learned Family Court, Shaheed Bhagat Singh

Nagar.

1. All the aforementioned 03 petitions are being disposed of by

this common order being arisen out of matrimonial dispute between the

parties; and the facts and issues involved therein are identical. For the

sake of brevity, the facts are being taken from TA-307-2024 titled as

‘Monika Rani vs. Mandeep Singh’, and parties are being referred to as per

their litigative status in the said petition.

2. Learned counsel for the petitioner-wife submits that the

petitioner seeks transfer of petition bearing No. HMA/668/2023

(Annexure P-3) titled as ‘Mandeep Singh vs. Monika Rani’, pending

before the learned Family Court, Shaheed Bhagat Singh Nagar to a

Court of competent jurisdiction at Jalandhar, inter alia, on the following

grounds :-

i) The parties were married on 12.10.2020 according to

Sikh Religious Rites and Ceremonies.

ii) One daughter was born out of the said wedlock on

26.02.2022 who is presently in the care and custody

of respondent-husband.

iii) Due to matrimonial discord the parties are residing

separately since 06.06.2022.

iv) The petitioner has no source of income and it totally

dependent upon her parents.

v) The distance between place of residence of the

petitioner-wife i.e. Jalandhar and the place of

proceedings filed by the respondent-husband at SBS

Nagar is about 50 kilometers on one side. It is very

difficult for her to frequently travel from Jalandhar to

Shaheed Bhagat Singh Nagar to attend the Court

proceedings.

vi) There are 02 cases filed by the petitioner wife

pending adjudication before the Courts at Jalandhar,

details of which are as under:-

(a) Case No. MNT125/21/2024 (Annexure P-1)

for grant of maintenance pending before the

learned Family Court, Jalandhar.

(b) Case No. COMA/2/2024 filed under Section

12 of the Protection of Women from Domestic

Violence Act, 2005 (Annexure P-2) pending

before the learned JMIC, Jalandhar.
