Present contempt petition has been filed alleging

violation of order dated 17.2.2025 (Annexure P-1) passed by a co-

ordinate Bench of this Court in CWP-2098-2021 titled as “Kuldeep

Singh and others vs. State of Punjab and others”, whereby the writ

petition was disposed of in terms of order dated 06.11.2023 passed by

the Division Bench of this Court in LPA-1629-2023 titled as “State of

Haryana and another vs. Pardeep Narayan”, whereby, it was observed

that “…..As a fall out and consequence of the afore-discussion, we

find that the respondent was rightly allowed the benefit of salary for

the period he performed duties on the higher post, regardless of any

condition incorporated as an impediment to his cause…….”.

Learned counsel appearing on behalf of the respondents,

on instructions, submits at the very outset that during the pendency of

the present contempt proceedings, the matter has been considered by

the competent authority and vide order dated 11.5.2026, approval has

been granted by the Finance Department for release of higher pay

scales to the petitioners. A copy of the said order has been handed

over in Court today and the same is taken on record. Copy thereof has

also been supplied to learned counsel for the petitioners.

Learned counsel for the petitioners, upon instructions,

submits that in view of the aforesaid development and the approval

now granted by the Finance Department, the grievance raised in the

present contempt petition substantially stands redressed and no further

direction is required to be passed by this Court at this stage. She

accordingly prays that the present petition may be disposed of.

I have heard learned counsel for the parties and perused

the record.

The jurisdiction of this Court under the Contempt of

Courts Act is essentially intended to ensure compliance of judicial

orders and not to punish where substantial compliance has been

effected during the pendency of the proceedings. From the material

placed on record, particularly the order dated 11.5.2026 issued

pursuant to approval granted by the Finance Department, it is evident

that the respondents have now initiated steps for implementation of

the directions issued by the Writ Court in the light of the law laid

down by the Division Bench in State of Haryana and another vs.

Pardeep Narayan.

In view of the statement made by learned counsel for the

petitioners that no further orders are required to be passed, this Court

is satisfied that no useful purpose would be served by keeping the

present contempt proceedings pending.

Accordingly, the present contempt petition is disposed of.

Rule stands discharged.

Pending application(s), if any, shall also stand disposed

of.
