Police Station Puranpur, District Pilibhit (UP) against Surjit Singh and Paramjit Singh and during investigation of the said FIR, it was found that the accused persons had prepared false passport and subsequently, the petitioner was also named as accused, while submitting the report under Section 173 Cr.P.C. with the allegations that he, along with two other persons, has also helped the main accused in preparation of the passport. It is further submitted that later on, when the present FIR was registered against one Gurjeet Singh @ Lada under Sections 307, 353, 186, 467, 468, 476 IPC and Section 25 of Arms Act relating to an incident, in which he was found involved in committing primary offence punishable under Section 307 IPC and during the investigation, he was found in possession of certain fake documents and on the basis of disclosure statement made by him, again it has come in the investigation that the petitioner has helped him in preparation of certain documents. Learned counsel relies upon earlier FIR No.891, in which there are same set of allegations regarding preparation of fake documents, which are again levelled against the petitioner and therefore, the second FIR qua the petitioner to this extent is not maintainable”.

The learned counsel for the petitioner has reiterated the above submissions and submitted that with regard to same set of allegations, one FIR already stands registered at Pilibhit (UP) and on the same set of allegations, now the present FIR has been registered by the Punjab Police due to extraneous considerations. Thus, the FIR and all the proceedings arising therefrom are liable to be quashed by this Court. 4. On the other hand, learned State counsel has opposed the submissions made by the learned counsel for the petitioner on the ground that undoubtedly the petitioner had helped the accused in preparing the fake passports and as a consequence FIR No. 891 dated 16.09.2017 under Sections 420, 467, 468 and 471 IPC and Section 12(1)B of Passport Act, Police Station Puranpur, District Pilibhit (UP) was ordered to be registered against the petitioner and others. However, even in Rajpura, three passports were recovered by the police and the petitioner had prepared those fake passports to help the accused in Rajpura also. Learned State counsel has specifically referred to the averments made in paragraphs No. 2, 3, 4 and 5 of the reply in this regard, which have been reproduced as under:-

“2.That the brief facts of the case are that the above noted case was registered at Police Station Sadar, Rajpura district Patiala that police party lead by Inspector/SHO, P.S. Sadar, Rajpura District Patiala were present near Shiv Temple for look out of suspects under special operations. Where, the Inspector received information that Gurjeet Singh alias Landa s/o Inderjit Singh r/o village Dhand Kansal Police Station Sarai Amanat Khan District Tran Taran who has links with many gangsters and who has constituted gang by teaming up with Vicky Gaundar, Harry Chatha, Gopi Ghanshampuria, Gop Koda, Sukh Bhikhriwal and Prema Lahoria etc. They used to conduct loots and stealings and Kidnap people to extort ransoms. Gurjeet Singh Nabha is want in Jail break case and he might be having lot of arms with him. Gurjit Singh has also prepared fake proofs with his photo. On the date of occurrence, he is coming from Chandigarh Mohali to Manakpur Agricultural fields and is going towards Rajpura in Pajero Blue white colour having fake number registration and if Naka is laid then he could be apprehended with fake numbered Pajero. Accordingly, Naka was laid at Jansua –Manakpur Road. After some time Pajero Car No. HR-26AX 2018, being driven by a young boy.
